(39) Bovenop de huidige richtlijn worden momenteel met betrekking tot de Middellandse Zee de nodige maatregelen genomen met het oog op de toetreding van de Europese Unie tot het Protocol inzake de bescherming van de Middellandse Zee tegen verontreiniging die het gevolg is van de exploratie en de exploitatie van het continentaal plat, de zeebodem en de ondergrond daarvan ("het Offshoreprotocol") bij het Verdrag inzake de bescherming van het mariene milieu en de kustgebieden van de Middellandse Zee ("het Verdrag van Barcelona"), goedgekeurd bij Besluit 77/585/EEG van de Raad.

(39) In relation to the Mediterranean Sea, and in addition to the obligations contained in this Directive, the necessary action has or is being undertaken to secure the accession of the European Union to the Protocol for the Protection of the Mediterranean Sea against Pollution Resulting from Exploration and Exploitation of the Continental Shelf and the Seabed and its Subsoil ('the Offshore Protocol') to the Convention for the Protection of the Marine Environment and the Coastal Region of the Mediterranean ('the Barcelona Convention'), which was approved by Council Decision 77/585/EEC.
(39) Bovenop de in de huidige richtlijn opgenomen verplichtingen wordt of is met betrekking tot de Middellandse Zee de nodige actie ondernomen om de toetreding van de Europese Unie te waarborgen tot het Protocol inzake de bescherming van de Middellandse Zee tegen verontreiniging die het gevolg is van de exploratie en de exploitatie van het continentaal plat, de zeebodem en de ondergrond daarvan ("het Offshore-protocol") bij het Verdrag inzake de bescherming van het mariene milieu en de kustgebieden van de Middellandse Zee ("het Verdrag van Barcelona"), goedgekeurd bij Besluit 77/585/EEG van de Raad.

The President of the Council is hereby authorised to designate the person(s) empowered to proceed, on behalf of the Union, to the deposit of the instrument of approval with the Government of Spain which assumes the functions of Depositary, as provided for in Article 32(2) of the Offshore Protocol, in order to express the consent of the Union to be bound by the Offshore Protocol (5).

While it is appropriate for the Union to act in support of safety of offshore exploration and exploitation activities, bearing in mind, inter alia, the high probability of cross-border effects of environmental problems related to such activities, the Member States and their relevant competent authorities should be responsible for certain detailed measures laid down in the Offshore Protocol.
Onder meer omdat het zeer waarschijnlijk is dat milieuproblemen die verband houden met offshore exploratie- en exploitatieactiviteiten een grensoverschrijdend karakter hebben, is het passend dat de Unie ondersteuning biedt voor de veiligheid van zulke activiteiten, maar het zijn de lidstaten en hun bevoegde autoriteiten die verantwoordelijk zijn voor bepaalde in het offshoreprotocol vastgestelde gedetailleerde maatregelen.

In relation to the Mediterranean Sea, in conjunction with this Directive, the necessary actions were undertaken for the Union to accede to the Protocol for the Protection of the Mediterranean Sea against Pollution Resulting from Exploration and Exploitation of the Continental Shelf and the Seabed and its Subsoil (17) (‘the Offshore Protocol’) to the Convention for the Protection of the Marine Environment and the Coastal Region of the Mediterranean (‘the Barcelona Convention’), which was concluded by Council Decision 77/585/EEC (18).

Having been adopted almost twenty years ago, when the approach to international environmental law was different, the Offshore Protocol may have its shortcomings when it comes to outlining a sustainable management system for offshore activities.
