The European Commission has requested Poland to bring its national laws on the assessment and management of flood risks into line with the Floods Directive (2007/60/EC. The Directive aims to reduce and manage the risks that floods pose to human health, the environment, economic activity and cultural heritage. Under EU law, Member States have to perform flood risk assessments for their river basins, and draw up emergency plans.The Commission identified shortcomings in Poland's transposition of this legislation into its domestic law, and sent a letter of formal notice on 18 October 2013. Poland subsequently notified the amended Water Act, but the transposition of the definition of 'flood' still remains problematic as it restricts the scope of the Directive by excluding some sources of flooding, which may have an impact on the implementation of the whole Directive in Poland. The Commission is therefore sending a reasoned opinion. If Poland fails to act within two months, the Commission may refer Poland the EU Court of Justice.
De Europese Commissie heeft Polen verzocht om zijn wettelijke regeling betreffende de beoordeling en het beheer van overstromingsrisico's in overeenstemming te brengen met de overstromingsrichtlijn (2007/60/EG). De richtlijn is gericht op de vermindering en de beheersing van de risico's van overstromingen voor de gezondheid van de mens, het milieu, de economische bedrijvigheid en het culturele erfgoed. De lidstaten moeten op grond van het EU-recht overstromingsrisicobeoordelingen voor hun stroomgebieden uitvoeren en noodplannen opstellen.De Commissie heeft tekortkomingen bij de omzetting van deze wetgeving door Polen vastgesteld en daarover op 18 oktober 2013 een schriftelijke aanmaning gestuurd. Polen heeft daarop kennis gegeven van wijziging van de waterwet, waarbij de omzetting van de definitie van "overstroming" echter problematisch blijft, aangezien die een beperking inhoudt van de werkingssfeer van de richtlijn doordat bepaalde oorzaken van overstromingen worden uitgesloten, wat van invloed kan zijn op de uitvoering van de hele richtlijn in Polen. Portugal is to receive a Reasoned Opinion for two reasons: firstly, because it failed to fully designate Moura/Mourão/Barrancos as a special protection area under the Wild Birds Directive. Secondly, because it approved the siting of a paper production plant in the area in spite of the negative effects that this would have on wild birds and their habitats.
