These exclusive rights limiting access to the market also have the effect of restricting or preventing, to the detriment of users, the use of satellite communications that could be offered, thereby holding back technical progress in this area. Because their investment decisions are likely to be based on exclusive rights, the undertakings concerned are often in a position to decide to give priority to terrestrial technologies, whereas new entrants might exploit satellite technology. The telecommunications organizations have generally given preference to
the development of optical-fibre terrestrial links ...[+++], and satellite communications have been used chiefly as a technical solution of last resort in cases where the cost of the terrestrial alternatives has been prohibitive, or for the purpose of data broadcasting and/or television broadcasting, rather than being used as a
fully complementary transmission technology in its own right. Thus the exclusive rights imply a restriction on the development of satellite communication, and this is incompatible with Article 90 of the Treaty, read in conjunction with Article 86.
14. Overwegende dat deze uitsluitende rechten, die de toegang tot de markt beperken, tevens tot gevolg hebben dat het aanbod van het gebruik van satellietcommunicatie ten nadele van de gebruikers wordt beperkt of verhinderd, waardoor de technische vooruitgang op dit gebied wordt afgeremd; dat, omdat de investeringsbeslissingen van de betrokken ondernemingen waarschijnlijk op uitsluitende rechten zijn gebaseerd, deze ondernemingen dikwijls in de positie verkeren dat zij kunnen besluiten prioriteit te geven aan terrestrische technologie, waar nieuwe partijen op de markt van satelliettechnologie gebruik zouden maken; dat de telecommunicatieorganisaties over het algemeen de voorkeur hebben gegeven aan de ontwikkeling van optische-vez
elverbindi ...[+++]ngen over land en zij satellietverbindingen hoofdzakelijk hebben gebruikt als een technische noodoplossing in gevallen waarin de kosten van de alternatieven over land te hoogd waren of ten behoeve van toepassingen op het gebied van datatransmissie en/of televisieuitzendingen, in plaats van zulke satellietverbindingen te gebruiken als een volledig complementaire, volwaardige transmissietechnologie; dat uitsluitende rechten dan ook een beperking van de ontwikkeling van de satellietcommunicatie inhouden, hetgeen onverenigbaar is met artikel 90 in samenhang met artikel 86 van het Verdrag;
