– having regard to the Oslo Accords (‘Declaration of Principles on Interim Self-Government Arrangements’) of 13 September 1993,
– gezien de Akkoorden van Oslo („Declaration of Principles on Interim Self-Government Arrangements”) van 13 september 1993,

– having regard to the Oslo Accords (Declaration of Principles on Interim Self-Government Arrangements) of 1993 and to the other agreements between Israel and the Palestinian Authority,
– gezien de akkoorden van Oslo (Beginselverklaring over interim-zelfbestuursregelingen) van 1993 en de andere overeenkomsten tussen Israël en de Palestijnse Autoriteit,

welcomes the fact that, on 20 May 2010, a special parliamentary committee was set up to amend and complete the legislative framework concerning the process to decentralise and strengthen local self-government, with the specific remit of furthering measures to implement the constitutional principles of local self-government and the decentralisation of public services, in strict compliance with the European Charter of Local Self-Government; supports this committee's aim of conducting a comprehensive assessment of the legal framework covering all aspects of activity by local and regional authorities, which will enable decentralisation to be fully implemented, including at sectoral level, in the fields of education, health, social protection, the environment, law and order, etc.; expresses the hope that the reform measures to strengthen local self-government will be implemented in a timely fashion, so that all the implementation mechanisms can be operational by the time of the local general elections in the summer of 2011;
Het Comité juicht het toe dat er op 20 mei 2010 een speciale parlementaire commissie in het leven is geroepen voor de aanpassing en aanvulling van de wetgeving inzake de decentralisatie en consolidatie van het lokaal zelfbestuur. Deze commissie moet er vooral op toezien dat er, geheel overeenkomstig het Europees Handvest inzake lokale autonomie, wordt doorgegaan met de tenuitvoerlegging van de grondwettelijke principes van lokaal zelfbestuur en decentralisatie van overheidsdiensten. Ook is het positief dat de commissie het wettelijk kader wil onderwerpen aan een uitgebreid onderzoek waarin alle aspecten van de door de lokale en regionale overheden ontplooide activiteiten aan bod moeten komen. Dit moet, ook op sectoraal niveau, een volledige tenuitvoerlegging van de decentralisatie op het gebied van onderwijs, gezondheidszorg, sociale bescherming, milieu, ordehandhaving enz. mogelijk maken. Het is te hopen dat de hervormingsmaatregelen voor verbetering van het lokaal zelfbestuur tijdig zullen worden doorgevoerd, zodat alle uitvoeringsmechanismen vóór de gemeenteraadsverkiezingen in de zomer van 2011 operationeel zullen zijn.

The provisional institutions of self-government (PISG) have fulfilled their core roles in their areas of competence. However, the United Nations Interim Administration Mission in Kosovo (UNMIK) still bears ultimate legislative and executive responsibility.

Over the reporting period, the performance of the Provisional Institutions of Self-Government (PISG) and public administration has started to improve, but deficiencies still need to be addressed with determination. The transfer of non-reserved competences from the United Nations Interim Administration Mission in Kosovo (UNMIK) to the PISG was completed by the end of 2003.

he Constitutional Court decides on conflicts of interest among the three branches of government and is authorised to assess the conformity of laws with the Constitution and the conformity of by-laws with the Constitution and laws. It is also empowered to decide upon constitutional petitions submitted by individuals who consider that their constitutional rights have been violated by the final acts of state authorities or bodies of local or regional self-government.
Het Constitutioneel Hof beslist bij belangenconflicten tussen de drie machten en toetst de verenigbaarheid van wetten met de grondwet en de verenigbaarheid van verordeningen met grondwet en wetten.
