TRADUCTIONS EN CONTEXTE

Regrets that it is still difficult for citizens to gain access to information held by EU institutions, the reason being that there is no common approach among the institutions geared to facilitate access to documents for citizens and based on complete transparency, communication and direct democracy; urges the EU institutions, bodies, offices and agencies to develop further a more proactive approach on transparency by proactively disclosing as many of their documents as possible, in the most simple, user-friendly and accessible way, by having documents translated upon request into other EU official languages, and by establishing proper, simple and inexpensive information access arrangements, including by digital and electronic means, allowing for the needs of people with disabilities; considers, in particular, that the accessibility of information should be improved on by means of easy-to-use interfaces and search systems; calls for the development of a common access point to the portals of the three institutions, building on the pilot project for the online platform for the proactive publication of EU institutions documents, and for harmonising search portals between departments of the same institution (including Directorates-General in the Commission); calls, as well, on the institutions to continue and strengthen the work of expanding knowledge of EU legislation and policies; believes that, to that end, the EU should make full use of the potential offered by new technologies (social networks, smartphone applications, etc.) in order to ensure complete and easy access to information.

By the first ground of appeal, it is argued that the General Court misinterpreted the third indent of Article 4(2) of Regulation (EC) No 1049/2001 (1) of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents (‘the openness regulation’) by taking the view that the Commission, when it relies on the exception for investigations, may base its decision on a general presumption that access should be denied in an EU pilot procedure insofar as it constitutes a step which precedes the possible initiation of Treaty infringement proceedings, and that the Commission did not err in law in interpreting the above provision of the openness regulation as meaning that it could refuse a request for access to the requested documents in an EU pilot matter without examining the documents specifically and individually.
Met het eerste middel wordt gesteld dat het Gerecht artikel 4, lid 2, derde streepje, van verordening (EG) nr. 1049/2001 (1) van het Europees Parlement en de Raad van 30 mei 2001 inzake de toegang van het publiek tot documenten van het Europees Parlement, de Raad en de Commissie (transparantieverordening) onjuist heeft uitgelegd door te oordelen dat de Commissie zich, bij het beroep op de uitzondering ter bescherming van onderzoeken, op een algemeen vermoeden mag baseren om de toegang te weigeren tot documenten betreffende een EU-pilot-procedure, voor zover die procedure een fase is die aan de eventuele inleiding van een beroep wegens niet-nakoming voorafgaat, en dat de Commissie geen blijk heeft gegeven van een onjuiste rechtsopvatting toen ze de voormelde bepaling van de transparantieverordening aldus uitlegde dat zij het verzoek om toegang tot de gevraagde documenten betreffende een EU-pilot-procedure mocht afwijzen zonder de documenten concreet en individueel te onderzoeken.

The date of filing of a Community trade mark application shall be the date on which documents containing the information specified in Article 26(1) are filed with the Office by the applicant or, if the application has been filed with the central office of a Member State or with the Benelux Office for Intellectual Property, with that office, subject to payment of the application fee within a period of one month of filing the abovementioned documents.

2. By derogation from paragraph 1, the date of filing of an application filed with the central industrial property office of a Member State or with the Benelux Design Office and reaching the Office more than two months after the date on which documents containing the information specified in Article 36(1) have been filed shall be the date of receipt of such documents by the Office.
