In order to provide transparency to market stakeholders whilst preventing market abuse and preserving confidentiality of the identities of position holders, the publication of aggregate weekly position reports on positions referred to in Article 58(1)(a) of Directive 2014/65/EU should only apply to contracts that are traded by a certain number of persons, above certain sizes as specified in this Regulation.

When a net short position reaches or crosses the notification threshold in accordance with Articles 5 and 7 or the disclosure threshold in accordance with Article 6 of Regulation (EU) No 236/2012, a legal entity within the group shall report and disclose in accordance with Articles 5 to 11 of Regulation (EU) No 236/2012 the net short position in a particular issuer calculated according to paragraph 1 provided that no net short position at group level calculated according to paragraph 2 reaches or crosses a notification or disclosure threshold’.

However, Article 13(3) of Delegated Regulation (EU) No 918/2012 currently only refers to the notification threshold of Article 5 of Regulation (EU) No 236/2012, on significant net short positions in shares, while it should also refer to the notification threshold of Article 7 of Regulation (EU) No 236/2012 on significant net short positions in sovereign debt.
Artikel 13, lid 3, van Gedelegeerde Verordening (EU) nr. 918/2012 verwijst momenteel alleen naar de meldingsdrempel van artikel 5 van Verordening (EU) nr. 236/2012, betreffende aanmerkelijke netto shortposities in aandelen, hoewel het ook naar de meldingsdrempel van artikel 7 van Verordening (EU) nr. 236/2012 betreffende aanmerkelijke netto shortposities in overheidsschuld zou moeten verwijzen.

Article 13 of Commission Delegated Regulation (EU) No 918/2012 (2) specifies, according to the empowerment provided in Article 3(7)(c) of Regulation (EU) No 236/2012, the method of calculating positions for legal entities within a group that have long or short positions in relation to a particular issuer.

3. When a net short position reaches or crosses the notification threshold in accordance with Article 5 or disclosure threshold in accordance with Article 6 of Regulation (EU) No 236/2012 then a legal entity within the group shall report, and disclose in accordance with Articles 5 to 11 of Regulation (EU) No 236/2012 the net short position in a particular issuer calculated according to paragraph 1 provided that no net short position at group level calculated according to paragraph 2 reaches or crosses a notification or disclosure threshold.
3. 5. For the purposes of this Regulation, the position remaining after deducting any long position that a natural or legal person holds in relation to issued sovereign debt and any long position in debt instruments of a sovereign issuer the pricing of which is highly correlated to the pricing of the given sovereign debt from any short position that that natural or legal person holds in relation to the same sovereign debt shall be considered a net short position in relation to the issued sovereign debt of the sovereign issuer concerned.
5. Voor de toepassing van deze verordening wordt de positie die overblijft nadat elke longpositie van een natuurlijke of rechtspersoon in uitgegeven overheidsschuld en elke longpositie in schuldinstrumenten van een overheidsemittent, waarvan de koers een hoge correlatie heeft met de koers van diezelfde overheidsschuld, in mindering zijn gebracht op elke shortpositie van deze natuurlijke of rechtspersoon in diezelfde overheidsschuld, aangemerkt als een netto shortpositie in de uitgegeven overheidsschuld van de desbetreffende overheidsemittent.
