The Commission will, when preparing the delegated acts referred to in Article 57c(2), ensure a simultaneous, timely and appropriate transmission of relevant documents to the European Parliament and the Council, and will carry out appropriate and transparent consultations well in advance, in particular with experts from competent authorities and bodies, professional associations and educational establishments of all the Member States, and where appropriate with experts from social partners.

‘competent authority’ means any body or authority which has a supervisory or regulatory role in a Member State in relation to service activities, including, in particular, administrative authorities, including courts acting as such, professional bodies, and those professional associations or other professional organisations which, in the exercise of their legal autonomy, regulate in a collective manner access to service activities or the exercise thereof.

(9) In order to promote the free movement of workers, freedom of establishment and the free provision of services, while ensuring an adequate level of qualification, various professional associations and organisations have established common platforms at European level under which professionals meeting a number of criteria relating to professional qualifications are awarded the right to bear the professional title awarded by those associations or organisations.

By way of derogation from Article 42, the following shall also be recognised as satisfying Article 20: training existing as of 5 August 1985, provided by “Fachhochschulen” in the Federal Republic of Germany over a period of three years, satisfying the requirements referred to in Article 42 and giving access to the activities referred to in Article 44 in that Member State under the professional title of “architect”, insofar as the training was followed by a four-year period of professional experience in the Federal Republic of Germany, as attested by a certificate issued by the professional association in whose roll the name of the architect wishing to benefit from the provisions of this Directive appears.

(5a) For the free provision of services, where the service provider moves to the territory of another Member State, provision should be made to enable the Member States to introduce a system for notification and pro forma registration with the professional association or similar body that would be competent in the territory if the professional were exercising the freedom of establishment, together with a requirement for temporary registration with the social security body of the host country, with the right to transfer contributions that have been made to the social security body of the country of establishment.
(5 bis) Voor het vrij verrichten van diensten door verplaatsing van de dienstverrichter naar een andere lidstaat, is het wenselijk dat de lidstaten de mogelijkheid hebben een systeem in te voeren voor communicatie en pro forma aansluiting bij de territoriaal bevoegde beroepsorde of soortgelijke organisatie ingeval de dienstverrichter gebruikmaakt van zijn recht op vrijheid van vestiging, naast een verplichting zich tijdelijk in te schrijven bij de instelling voor sociale zekerheid van het land van bestemming, met het recht de gestorte premies over te dragen aan de instelling voor sociale zekerheid van het land van vestiging.

Where services are to be provided, the Member State shall exempt nationals of other Member States from the obligation of authorisation by, registration with, or membership of a professional association or similar body even where it requires its own nationals to fulfil that obligation in order to be admitted to practise or carry on professional activities.

Voor dienstverrichtingen stelt de ontvangende lidstaat onderdanen van andere lidstaten vrij van de verplichting bij een beroepsorde of soortgelijke organisatie een vergunning aan te vragen, zich daarbij te laten registreren of aan te sluiten, zelfs indien de betrokken lidstaat van haar eigen ingezetenen eist dat zij aan deze verplichting voldoen teneinde tot de uitoefening van het beroep of het verrichten van beroepswerkzaamheden te worden toegelaten.

Without prejudice to the autonomy of professional bodies and associations, Member States and the Commission shall encourage professional associations and bodies to establish codes of conduct at Community level in order to determine the types of information that can be given for the purposes of commercial communication in conformity with the rules referred to in paragraph 1
2. Onverminderd de autonomie van de beroepsverenigingen en -organisaties stimuleren de lidstaten en de Commissie deze verenigingen en organisaties om gedragscodes op communautair niveau op te stellen, waarin wordt vastgelegd welke informatie in overeenstemming met lid 1 voor commerciële communicatie mag worden verstrekt.
