11. Welcomes the proposal for a directive of the European Parliament and the Council of 31 March 2011 (COM(2011)0142) seeking to impose restrictions on credit agreements relating to residential property and hence contain excessive household debt; calls for EU mortgage provisions to incorporate best practices which are as favourable as possible to consumers; urges the inclusion of procedures for the renegotiation and rescheduling of debt repayments for insolvent individuals and families; calls on the Member States to prevent evicted households being forced to keep up their mortgage repayments; calls on the Commission and the Member States to take action in response to the social hardship caused to those most affected by the economic crisis and by unemployment and who are being evicted and deprived of their homes; notes that this is occurring against a backdrop of major public assistance initiatives designed to put the financial system back on a sound footing; calls on the Member States to strive to offer alternatives solutions to evictions;

Thus, the Commission considers that the 2009 rescheduling of the company’s public insurance debts has conferred an advantage within the meaning of Article 107(1) TFEU on the company.

– Fairness: the Member State will consult creditors on the design of any rescheduling or restructuring of public debt with a view to reaching negotiated solutions.

In the Judgment of the Court of Justice of the European Communities of 29 April 1999 in Case C-342/96 Spain v Commission (hereinafter Tubacex) (3), the Court considered that the debt rescheduling agreements concluded by the TGSS and FOGASA did not constitute State Aid as those public institutions had acted as a private creditor would have done to try to recover amounts owed to it, provided that the interest rate was at least equal to the rate that a private creditor would have applied (4) and that the rescheduling agreement did not result in new debts being accumulated.

Furthermore, by granting the debt rescheduling, the State should have acted like a public or private creditor that seeks to recover sums due to it and, to that end, concludes debt rescheduling agreements to facilitate payment (67).

Its behaviour should therefore be compared with that of a public or private creditor that seeks to recover sums due to it and, to that end, concludes agreements with the debtor under which the accumulated debts are to be rescheduled or paid by instalments in order to facilitate their repayment (54). The interest normally applicable to that type of debt is intended to make good the loss suffered by the creditor because of the debtor's delay in performing its obligation to pay off its debt, namely default interest.

It transpires from the above that, leaving aside possible public service obligations imposed on RTP, the following measures involve state aid within the meaning of Article 87(1) of the EC Treaty: the debt rescheduling with the social security scheme, the capital injections during the period 1994 to 1997 and the loan granted in 1998.
Uit het bovenstaande vloeit voort dat, los van de eventuele openbaredienstverplichtingen van RTP, de volgende maatregelen staatssteun bevatten in de zin van artikel 87, lid 1, van het EG-Verdrag: de herschikking van de schuld jegens de Segurança Social, de kapitaalinjecties in de periode 1994-1997 en de in 1998 verstrekte lening.

7. Whilst it acknowledges the difficulty, when evaluating economic performance, of determining what proportion is due to reforms and their implementation and what proportion is due to external factors, the Council, in the light of the general evaluation work carried out by many multilateral and bilateral donors, makes a tempered assessment of the effects of structural adjustment and notes that: - countries which have adopted adjustment policies have - as a result of a combination of increased flows of aid, liberalization of exchange rates and deregulation of foreign trade - on average achieved greater efficiency in allocation of resources and growth in their income and exports; - the adjustment programmes have limited the impact of serious macro-economic imbalances on essential public services; - the adjustment policies have generally led to reductions in budget deficits; - inflation has generally been better controlled in countries under adjustment; - real exchange rates have, in countries under adjustment, been brought back to levels more compatible with the economic fundamentals; but that in many cases, concentrated in particular in certain regions : - structural rigidities in the economies concerned have led to inappropriate allocation of resources which, in particular in the social sectors, has penalized basic services; - the significant reduction in public expenditure has been made to the detriment of maintaining economic and social infrastructure, which often has no longer been kept up, and, in certain cases, to the detriment of the proper functioning of essential government bodies; - investment has stagnated or even declined; - external imbalances influenced by trends in trade and capital transfers have not been corrected in a lasting way despite the efforts of certain debtors to cancel or reschedule debts; - the real involvement of representatives of the countries concerned in defining the programmes was inadequate.
7. De Raad erkent dat het, bij het evalueren van economische prestaties, moeilijk is om te beoordelen welk aandeel de hervormingen en de tenuitvoerlegging daarvan innemen en welk aandeel de exogene factoren voor hun rekening nemen. In het licht van het algemene evaluatiewerk van talrijke multilaterale en bilaterale donors heeft hij zich evenwel een genuanceerd oordeel gevormd over de gevolgen van de structurele aanpassing en constateert hij het volgende : - de landen met een aanpassingsbeleid hebben - dank zij een combinatie van de toegenomen hulpstromen, de liberalisering van de wisselkoersen en de deregulering van de externe handel- gemiddeld een betere doeltreffendheid bereikt wat de toewijzing van de middelen en de groei van hun inkomens en hun export betreft, - door de aanpassingsprogramma's is de weerslag van de ernstige macro- economische wanverhoudingen op de essentiële overheidsdiensten beperkt gebleven, - dank zij het aanpassingsbeleid is het over het algemeen mogelijk geweest de begrotingstekorten terug te brengen, - de inflatie werd over het algemeen het best in toom gehouden in de landen met een aanpassingsbeleid, - de reële wisselkoersen werden in de landen met een aanpassingsbeleid teruggebracht tot niveaus die meer verenigbaar zijn met de economische parameters. Maar anderzijds deed zich in vele gevallen, vooral in bepaalde gebieden, het volgende voor : - de structurele stroefheid van de betrokken economieën leidde tot een verkeerde toewijzing van de middelen, wat met name in de sociale sector de basisvoorzieningen benadeelde, - de aanmerkelijke daling van de overheidsuitgaven ging ten koste van de acties voor het onderhouden van de economische en sociale structuur, die vaak tekort schoot, en, in sommige gevallen, van de goede werking van de belangrijkste overheidsdiensten, - de investeringen zijn gestagneerd voor zover zij niet zijn gedaald, - de externe wanverhoudingen, die werden beïnvloed door de tendensen in het handelsverkeer en in de kapitaalo ...
