Nothing in this Regulation should prevent a competent authority from requiring an operator to transfer a number of allowances, received in excess of its adjusted allocation for the relevant year, to the EU Allocation Account in cases where there has been an over allocation of allowances, including as a result of an error in the original allocation or the operator having failed to correctly or completely submit to the competent authority information pursuant to Article 24 of Decision 2011/278/EU by the date set out in that Article, provided that the central administrator has made a change to the national allocation table of the Member State pursuant to Article 52(2) of this Regulation to adjust the allocation accordingly.
Niets in deze verordening mag verhinderen dat een bevoegde autoriteit eist dat een exploitant een aantal bovenop de aangepaste toewijzing voor het desbetreffende jaar ontvangen emissierechten overdraagt naar de EU-toewijzingsrekening als er teveel emissierechten zijn toegewezen, waaronder als gevolg van een fout in de oorspronkelijke toewijzing of wanneer de exploitant heeft verzuimd om de bevoegde autoriteit tijdig te voorzien van correcte of volledige informatie ingevolge artikel 24 van Besluit 2011/278/EU en voor de daarin genoemde datum, mits de centrale administrateur de nationale toewijzingstabel van de lidstaat volgens artikel 52, lid 2, van deze verordening navenant heeft gewijzigd.

4. In the case of allocation to new entrants or allocation to new entrants following a significant capacity extension pursuant to Articles 19 and 20 of Decision 2011/278/EU, the resulting final amount of allowances allocated free of charge to the operator for the whole trading period, which is entered into the EUTL in accordance with Article 51(2) of this Regulation, shall be transferred by the central administrator from the EU New Entrant Reserve Account to the EU Allocation Account.
4. Bij toewijzing aan nieuwkomers of toewijzing aan nieuwkomers na een aanzienlijke capaciteitsuitbreiding op grond van de artikelen 19 en 20 van Besluit 2011/278/EU wordt het daaruit voortvloeiende definitieve aantal emissierechten dat voor de hele handelsperiode kosteloos aan de exploitant wordt toegewezen en overeenkomstig artikel 51, lid 2, van deze verordening in het EUTL wordt ingevoerd, door de centrale administrateur overgedragen van de EU-rekening voor de nieuwkomersreserve naar de EU-toewijzingsrekening.

4. In the case of allocation from the special reserve pursuant to Article 3f of Directive 2003/87/EC, the resulting final amount of aviation allowances allocated free of charge to the aircraft operator for the whole trading period, entered into the EUTL in accordance with Article 54(2) of this Regulation, shall be automatically transferred from the EU Special Reserve Account to the EU Aviation Allocation Account.
4. Bij toewijzing uit de bijzondere reserve op grond van artikel 3 septies van Richtlijn 2003/87/EG wordt het daaruit voortvloeiende definitieve aantal luchtvaartemissierechten dat voor de hele handelsperiode kosteloos aan de vliegtuigexploitant wordt toegewezen en overeenkomstig artikel 54, lid 2, van deze verordening in het EUTL wordt ingevoerd, automatisch van de EU-rekening voor de bijzondere reserve naar de EU-luchtvaarttoewijzingsrekening overgedragen.

If the situation giving rise to the suspension of access to accounts pursuant to Article 34 is not resolved within a reasonable period despite repeated notifications, the competent authority may instruct the national administrator to close, or in the case of operator holding accounts or aircraft operator holding accounts to set to blocked status, those accounts for which access is suspended until the competent authority determines that the situation giving rise to the suspension no longer subsists.

The national dispute settlement body shall, taking full account of the principle of proportionality, issue a binding decision to resolve the dispute within the shortest possible time frame and in any case within two months, except in exceptional circumstances, without prejudice to the possibility of any party to refer the case to a court.

6. Without prejudice to the existing appeal procedures and to the provisions of Article 30, in case of disputes relating to the allocation of infrastructure capacity, a dispute resolution system shall be made available in order to resolve such disputes promptly.
6. Onverminderd de bestaande beroepsprocedures en het bepaalde in artikel 30 wordt voor geschillen in verband met de toewijzing van infrastructuurcapaciteit een regeling ingesteld om dergelijke geschillen snel te beslechten.

(4) Whereas the third subparagraph of Article 7(3) of Regulation (EC) No 1260/1999 stipulates, in the case of Objectives 1 and 2, that these breakdowns are to distinguish allocations of appropriations to regions and areas benefiting from transitional support, that these allocations are to be determined in accordance with the criteria referred to in the first subparagraph of that Article and that the annual breakdown of these appropriations is to be degressive as from 1 January 2000 and must be lower in 2000 than in 1999; whereas the transitional support profile may be tailored to the specific needs of the individual regions, and whereas the Commission has taken into consideration the Member States' requests in this respect, taking account of the annual breakdown of Structural Fund resources set out in the Annex to Regulation (EC) No 1260/1999;
(4) Overwegende dat in artikel 7, lid 3, derde alinea, van Verordening (EG) nr. 1260/1999 is bepaald dat voor de doelstellingen 1 en 2 bij deze verdelingen de toewijzingen van kredieten aan de regio's en zones waar overgangssteun wordt verleend afzonderlijk worden vermeld, dat deze toewijzingen worden bepaald aan de hand van de in de eerste alinea van dat lid bedoelde criteria en dat de verdeling van deze kredieten over de betrokken jaren vanaf 1 januari 2000 degressief is, waarbij het bedrag voor 2000 kleiner is dan dat voor 1999; dat het patroon van de overgangssteun kan worden aangepast naar gelang van de specifieke behoeften van de verschillende regio's en dat de Commissie de in dit verband door de lidstaten gedane verzoeken in aanmerking heeft genomen, daarbij rekening houdend met de in de bijlage bij Verordening (EG) nr. 1260/1999 opgenomen verdeling van de middelen van de structuurfondsen over de betrokken jaren;
