EU countries must ensure that performers phonogram producers, producers of the first fixations of films and broadcasting organisations have an exclusive right to make available to the public, by sale or otherwise, fixations of their performances, their phonograms, the original and copies of their films and fixations of their broadcasts.

If, upon reversion, the performer has had a reasonable period of time to make available to the public the phonogram which, but for the term extension, would be no longer protected, the phonogram is not made available to the public, the rights in the phonogram and in the fixation of the performance should expire.

Its adoption is also a precondition for the Community and its Member States acceding to the WIPO Copyright Treaty (WCT) and the WIPO Performances and Phonograms Treaty (WPPT), concluded in December 1996.
