B. whereas human rights defender Ales Bialiatski, Chair of the ‘Viasna’ Human Rights Centre and Vice-President of the International Federation for Human Rights (FIDH), after being held at the detention centre of the Belarusian Interior Ministry, was arrested in Minsk on 4 August 2011 on the formal charge of large-scale tax evasion (‘concealment of profits on a particularly large scale’) and indicted on 12 August 2011 under Part II of Article 243 of the Belarusian Criminal Code; whereas he faces a penalty of either up to five years' ‘restricted freedom’ or three to seven years' imprisonment and the confiscation of his assets, including the premises from which ‘Viasna’ is run;
B. overwegende dat de heer Ales Bialiatski, mensenrechtenactivist, voorzitter van het mensenrechtencentrum Viasna en ondervoorzitter van de Internationale federatie voor de mensenrechten (FIDH), na een periode van opsluiting in het detentiecentrum van het Belarussische Ministerie van Binnenlandse Zaken op 4 augustus 2011 in Minsk werd gearresteerd op beschuldiging van grootschalige belastingontduiking („verduistering van aanzienlijke inkomsten”) en op 12 augustus 2011 uit hoofde van artikel 243, deel II, van het Belarussische strafwetboek werd aangeklaagd; overwegende dat hem een straf te wachten staat van ofwel maximum vijf jaar „vrijheidsbeperking”, ofwel drie tot zeven jaar opsluiting, en dat zijn bezittingen, met inbegrip van de gebouwen van waaruit Viasna geleid wordt, in beslag zullen worden genomen,

Since the objective of this Directive, namely to set common principles for the levying of airport charges at Community airports, cannot be sufficiently achieved by the Member States as systems of airport charges can not be put in place at national level in a uniform way throughout the Community and can therefore, by reason of its scale and effects, be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.

(13) Since the objectives of this Directive cannot be sufficiently achieved by the Member States as airport charges systems cannot be put in place at national level in a uniform way throughout the Community, and can therefore, by reason of its scale and effects, be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.

In cases where expenditure is not charged to the Union budget, it shall be charged to the Member States in accordance with the gross national product scale, unless the Council acting unanimously decides otherwise.

2. Where charges are applied, public authorities shall publish and make available to those requesting information the scale of charges, specifying in what circumstances charges may or may not apply.
