TRADUCTIONS EN CONTEXTE

The persistence of amounts to be settled for the programmes covered by these provisions is due to the fact that the applications for the final balance required by that provision were made for the programmes concerned but, because of unresolved legal proceedings, checks on suspected irregularities, or both reasons, the remaining amount cannot be finally settled.

As regards the closure of programmes from before 1994, the bulk of balances were paid during 2001, so reducing the amounts still to be settled from EUR581 million to EUR315 million for Objective 1, from EUR144 million to EUR88 million for Objective 2 and from EUR146 million to EUR62 million for the Community Initiatives.

Where the Member State does not agree to settle the dispute, the Commission may nonetheless decide to settle provided that such settlement does not have any financial or budgetary implications for the Member State concerned on the basis of a full and balanced factual analysis and legal reasoning, taking account of the Member State’s analysis and demonstrating the financial interests of the Union and of the Member State concerned.

3. In the event that the Commission does not consent to settle the dispute, the Commission may decide, based on a full, balanced, factual analysis and legal reasoning provided to Member States in accordance with the examination procedure referred to in Article 22(3) to refuse to settle.
