Ms Richards appealed against that decision and the Social Security Commissioner, hearing the case on appeal from the Social Security Appeal Tribunal, has asked the Court of Justice of the European Communities whether such a refusal is contrary to the Community directive on equal treatment in the field of social security.

For the purpose of acquiring periods in the pension insurance, attendance at a school or comparable educational establishment in another Member State shall be regarded as equivalent to attendance at a school or educational establishment pursuant to Articles 227(1)(1) and 228(1)(3) of the Allgemeines Sozialversicherungsgesetz (ASVG) (general social security act), Article 116(7) of the Gewerbliches Sozialversicherungsgesetz (GSVG) (Federal Act on Social Insurance for Persons engaged in Trade and Commerce) and Article 107(7) of the Bauern-Sozialversicherungsgesetz (BSVG) (social security act for farmers), when the person concerned was subject at some time to Austrian legislation on the grounds that he pursued an activity as an employed or self-employed person, and the special contributions provided for under Article 227(3) of the ASVG, Article 116(9) of the GSVG and Article 107(9) of the BSGV for the purchase of such periods of education, are paid.

Where [DG 12 of the new Implementing Regulation] leads to periods of childcare pursuant to Articles 227a and 228a of the Allgemeines Sozialversicherungsgesetz (ASVG) (general social security act), Articles 116a and 116b of the Gewerbliches Sozialversicherungsgesetz (GSVG) (Federal Act on Social Insurance for Persons engaged in Trade and Commerce) and Articles 107a and 107b of the Bauern-Sozialversicherungsgesetz (BSVG) (social security act for farmers) being superseded by insurance periods completed in another Member State, the theoretical amount calculated pursuant to Article 52(1)(b)(i) must be increased by the amount which would arise under Austrian legislation if the periods of childcare were taken into account for those insurance periods.
2. a) social security fraud is defined as acting or omitting to act, in order to obtain or receive social security benefit or to avoid obligations to pay social security contributions, contrary to the law of a Member State;

Moreover, the second directive dealing with equal treatment for men and women, Directive 76/207[4] adopted on 9 February 1976 concerning equal treatment as regards access to employment, vocational training and promotion, and working conditions, excluded social security from its scope, stating (Article 1(2)) that the Council, acting on a proposal from the Commission, would at a later stage adopt a directive dealing specifically with social security.
Overigens sloot de tweede richtlijn inzake de gelijke behandeling van mannen en vrouwen, Richtlijn 76/207 van 9 februari betreffende de gelijke behandeling van mannen en vrouwen ten aanzien van de toegang tot het arbeidsproces, de beroepsopleiding en de promotiekansen en ten aanzien van de arbeidsvoorwaarden[4] , de sociale zekerheid van haar werkingssfeer uit, waarbij werd verduidelijkt (artikel 1, lid 2) dat de Raad bij een andere gelegenheid op voorstel van de Commissie een richtlijn betreffende de sociale zekerheid moest goedkeuren.

On March 2003 the Commission, acting as Secretariat of the Administrative Commission for Social Security of Migrant Workers (CASSTM), which is the competent body in this area, tabled a draft Decision laying down the overall characteristics of the EIHC.
