The Commission should also be empowered to adopt implementing technical standards by means of implementing acts pursuant to Article 291 TFEU and in accordance with Article 15 of Regulation (EU) No 1095/2010 with regard to standard forms and templates for reporting on internalised settlement; for the application for authorisation by CSDs; for the provision of information between different competent authorities for the purposes of supervision of CSDs; for the relevant cooperation arrangements between authorities of home and host Member States; for formats of records to be kept by CSDs; for the procedures in cases where a participant or an issuer is denied access to a CSD, CSDs are denied access between themselves or between CSDs and other market infrastructures; and for the consultation of different authorities prior to granting authorisation to a settlement agent.
Aan de Commissie moet tevens de bevoegdheid worden toegekend om door middel van uitvoeringshandelingen overeenkomstig artikel 291 VWEU en artikel 15 van Verordening (EU) nr. 1095/2010 technische uitvoeringsnormen vast te stellen ten aanzien van standaardformulieren en modellen voor verslaglegging over interne afwikkelingsoperaties, voor de vergunningsaanvraag door CSD’s, voor de informatieverstrekking tussen verschillende bevoegde autoriteiten met het oog op het toezicht op CSD’s, voor de betrokken samenwerkingsregelingen tussen de autoriteiten van de lidstaat van herkomst en de lidstaat van ontvangst, voor de formats van de vastleggingen die door de CSD’s moeten worden bewaard, voor de procedures in gevallen waarin een deelnemer of een uitgevende instelling de toegang tot een CSD is ontzegd of waarin CSD’s onderling of ten aanzien van andere marktinfrastructuren de toegang is ontzegd, en voor de raadpleging van verschillende autoriteiten vóór vergunningverlening aan een afwikkelende instantie.

23. Stresses that an increasing number of journalists find themselves employed under precarious conditions, lacking the social guarantees that are usual on the job market, and calls for the improvement of the working conditions of media professionals; emphasises that Member States must ensure that journalists’ working conditions comply with the provisions of the European Social Charter; stresses the importance of collective contracts for journalists and of trade union representation of journalists’ collectives, which must be permitted for all employees, even if they are members of a small group, work in small companies or have non-standard forms of contract, such as temporary or interim work, as security of employment allows them to speak and act together and more easily and effectively uphold their professional standards;

9. The Commission may set out standard forms and procedures for prior authorisations and consultations referred to in paragraphs 1 and 2, and standard forms and procedures for informing the supervisory authorities pursuant to paragraph 6.

Accordingly, it must be possible to draw up the technical specifications in terms of functional performance and requirements, and, where reference is made to the European standard or, in the absence thereof, to the national standard, tenders based on equivalent arrangements must be considered by contracting authorities. To demonstrate equivalence, tenderers should be permitted to use any form of evidence. Contracting authorities must be able to provide a reason for any decision that equivalence does not exist in a given case. Contracting authorities that wish to define environmental requirements for the technical specifications of a given contract may lay down the environmental characteristics and/or specific environmental effects of product groups or services. They can, but are not obliged to, use appropriate specifications that are defined in eco-labels, such as the European Eco-label, (multi-)national eco-labels or any other eco-label providing the requirements for the label are drawn up and adopted on the basis of scientific information using a procedure in which stakeholders, such as government bodies, consumers, manufacturers, distributors and environmental organisations can participate, and providing the label is accessible and available to all interested parties. Whenever possible, the contracting authority shall take into account accessibility criteria for people with disabilities or design for all when laying down specifications. These technical specifications should be clearly indicated so that all tenderers fully understand the requirements established by the contracting authority.
Zij kunnen, zonder dat daartoe een verplichting bestaat, de passende specificaties gebruiken die zijn omschreven in milieukeuren, zoals de Europese milieukeur, (pluri‑)nationale milieukeuren of een andere milieukeur indien de vereisten voor de keur zijn ontwikkeld en aangenomen op grond van wetenschappelijke gegevens via een proces waaraan de betrokkenen, zoals regeringsinstanties, consumenten, fabrikanten, kleinhandel en milieuorganisaties, kunnen deelnemen en indien de keur toegankelijk en beschikbaar is voor alle betrokken partijen. In addition to the frequent case of a deliberate clause inserted in the contract, the choice of law can therefore be ascertained either from other provisions of the contract or from aspects of the contractual environment: the first situation would include, for example, acceptance of a standard-form contract governed by a specific legal system, even in the absence of any deliberate clarification as to the applicable law, the text leaving it to the court to check that the choice, though tacit, is real, or a reference to provisions of a given law without this law being designated in the aggregate.
De rechtskeuze kan dus niet alleen worden gedaan door opneming van een uitdrukkelijke bepaling in de overeenkomst, zoals vaak het geval is, maar kan ook blijken uit andere bepalingen van de overeenkomst of uit de context ervan.
