In line with the high dependence of the Azores on milk production, combined with other handicaps connected with their distant location and the absence of profitable alternative lines of production, the derogation from certain provisions of Council Regulation (EC) No 1788/2003 of 29 September 2003 establishing a levy in the milk and milk products sector , introduced by Article 23 of Council Regulation (EC) No 1453/2001 of 28 June 2001 introducing specific measures for certain agricultural products for the Azores and Madeira (Poseima) and renewed by Council Regulation (EC) No 55/2004 should be confirmed with respect to the application of the supplementary levy in the milk and milk products sector in the Azores.

The Commission will pay attention as well to supplementary levy wrongly charged to some Azorean producers as to no payment of supplementary levy related to producers in overshot.

For the minimum price for beet, the one-off amount levied on the additional sugar quotas and on the supplementary isoglucose quotas, and the surplus amount and the production charge referred to in Articles 5, 8(3), 9(3), 15 and 16 respectively of Regulation (EC) No 318/2006, the operative event for the exchange rate shall be 1 October of the marketing year in respect of which the prices and amounts are applied or paid.

4.1.10. The sectoral regulations applicable to agriculture, where very high "negative expenditure" is provided for (i.e. the amounts recovered following fraud or irregularities, the supplementary levy on milk, etc.), stipulate that such expenditure is to be transformed into earmarked revenue. The Financial Regulation (Article 17 of the proposal) provides for two types of earmarked revenue:
