OLAF shall exercise the power conferred on the Commission by Council Regulation (Euratom, EC) No 2185/96 of 11 November 1996 concerning on-the-spot checks and inspections carried out by the Commission in order to protect the European Communities' financial interests against fraud and other irregularities to carry out on-the-spot inspections and checks in the Member States and, in accordance with the cooperation and mutual assistance agreements in force, in third countries and on the premises of international organisations.

In order to step up the fight against fraud, corruption and any other illegal activity affecting the financial interests of the European Community, the European Anti-Fraud Office established by Commission Decision 1999/352/EC, ECSC, Euratom (hereinafter "the Office") shall exercise the powers of investigation conferred on the Commission by the Community rules and Regulations in the Member States and, in accordance with the cooperation and mutual assistance agreements in force, in third countries.

While the formal agreement and ownership of third countries should be sought, the thematic programme will give the Community a certain autonomy and flexibility vis-à-vis governments of beneficiary countries: the Commission will be free to fund actions through NGO’s and other actors of the civil society without government’s agreement, in cases where cooperation is restricted or in situations of difficult partnership.
Ofschoon formele instemming en eigen inbreng van derde landen dient te worden nagestreefd, zal het thematisch programma de Gemeenschap enige autonomie en flexibiliteit ten opzichte van de regeringen van de in aanmerking komende landen verschaffen: het zal de Commissie vrijstaan om acties via NGO’s en andere actoren van het maatschappelijk middenveld te financieren, ook zonder instemming op regeringsniveau, in die gevallen waarin de samenwerking is beperkt of sprake is van een moeizaam partnerschap.
