This derogation concerns international passenger transport carried out by taxable persons not established in Austria by means of motor vehicles not registered in Austria.

These proposals, which will have to take account of the need to modernize the existing provisions, will relate to: . determination of the physical scope of the tax, including the precise definition of taxable transactions (uniform definition of the supply of goods, the concept of the supply of services, the fact that the supplies are made for consideration, etc.); the precise determination of the territorial scope of the tax will be looked into in phase three; . definition of the concept of the taxable person for VAT purposes (which involves reviewing the VAT status of public bodies, the consequences of treatment as a non-taxable person, etc.); . determination of the taxable amount for taxable transactions; . exemptions: maintenance or abolition and, in any event, harmonization of exemptions, consequences for the right to deduct, etc.; . the right to deduct: conditions giving rise to and governing exercise of the right to deduct, procedures, harmonization of the non-deductibility of certain items of expenditure, deductible proportion (general proportion, actual application), i.e. the ratio of deductible transactions to non-deductible transactions (because exempt or outside the scope of the tax).
Deze voorstellen, waarin rekening moet worden gehouden met de absoluut noodzakelijke modernisering van de huidige bepalingen, zullen betrekking hebben op: . de bepaling van de materiële werkingssfeer van de belasting, met inbegrip van de nauwkeurige definitie van de belastbare handelingen (uniforme definitie van de levering van goederen, van het begrip dienstverrichting, van het feit dat de handelingen onder bezwarende titel worden verricht, enz); de nauwkeurige bepaling van de territoriale werkingssfeer van de belasting zal in de vierde fase plaatsvinden; . de definitie van het begrip BTW-plichtig (hetgeen een herziening van het BTW-statuut van overheidsinstanties, van de consequenties van het niet-belastingplichtig zijn, enz impliceert); . de bepaling van de maatstaf van heffing voor belastbare handelingen; . de vrijstellingen: handhaving of afschaffing en in elk geval harmonisatie ervan, gevolgen ervan voor het recht op aftrek, enz; . het recht op aftrek: voorwaarden voor het ontstaan en de uitoefening van het recht, modaliteiten ervan, harmonisatie van de uitsluiting van sommige uitgaven, pro rata voor de toepassing van de aftrek (algemeen verhoudingsgetal, werkelijke verdeling) voor handelingen die recht op aftrek geven en handelingen die geen recht op aftrek geven (vrijgestelde handelingen of handelingen die buiten de werkingssfeer vallen).

The difficulties thrown up by these arrangements are known: - if the place of taxation of the supply is shifted to the Member State in which the goods are used/consumed, taxable suppliers are burdened with obligations (identification, regular returns, etc.) which have to be complied with in Member States in which they are not established; - if taxation at destination is applied via the purchaser, statement obligations are imposed on traders normally released from them (taxable persons exempted from tax, non-taxable legal persons, individuals), who are then required to make all or part of their intra-Community acquisitions subject to the tax; - if transactions intended for consumption/use in another Member State can be exempted from VAT, the treatment of domestic and intra-Community transactions is no longer equal: intra-Community purchases require no disbursement of the amount of the tax when the purchaser is a taxable person with the full right of deduction.
De moeilijkheden die zich bij deze regeling voordoen zijn bekend : - indien de plaats van belastingheffing op de levering naar de Lid- Staten van gebruik/verbruik van de goederen wordt verplaatst, moeten de belastingplichtige leveranciers aan verplichtingen (indentificatie, periodieke aangifte, enz) voldoen in Lid-Staten waar zij niet gevestigd zijn; - indien de belastingheffing ter bestemming plaatsvindt bij de koper komen aangifteverplichtingen ten laste van bedrijven die daar in beginsel van zijn vrijgesteld (belastingplichtigen waarop een vrijstellingsregeling van toepassing is, niet-belastingplichtinge rechtspersonen, particulieren) en die derhalve alle of een deel van hun communautaire verwervingen aan de belasting moeten onderwerpen; - indien transacties die strekken tot een verbruik/gebruik in een andere Lid-Staat in aanmeking kunnen komen voor een BTW- vrijstelling, is de gelijkheid van behandeling tussen binnenlandse en intracommunautaire transacties verbroken : voor intracommunautaire aankopen behoeft geen belasting betaald te worden wanneer de koper een belastingplichtige is die volledig recht op aftrek heeft.

In this instance, in which the place of origin is considered to be the place where the goods are when the supply is effected or the transport commences, can one resolve the difficulties encountered today: - by taxable persons who carry out transactions in a Member State in which they are not established; - by the principal of an intra-Community processing operation when he supplies the goods (as raw materials or as a processed product) from the Member State in which processing has taken place; - with storage in a Member State other than that of establishment, or where goods are supplied directly from the place of storage; - with the supply of goods acquired in another Member State when the transport to the final acquirer begins in that Member State, in which the taxable person is not established; - in providing a simple form of tax treatment for chain transactions, given the taxation of all the intermediary transactions in the Member State in which the goods are located.
Indien als plaats van herkomst wordt uitgegaan van de plaats waar de goederen zich bevinden op het tijdstip dat de levering wordt verricht of op het tijdstip van het vertrek van het vervoer, kunnen dan de moeilijkheden worden opgelost die zich thans voordoen : - voor belastingplichtigen die transacties verrichten in een Lid- Staat waarin zij niet gevestigd zijn? - voor de opdrachtgever van een transactie tot intracommunautaire veredeling wanneer hij de goederen (als grondstoffen of als eindprodukt) levert uit de Lid-Staat van veredeling? - ingeval van opslag in een andere Lid-Staat dan die van de vestiging of in geval van rechtstreekse levering van de goederen vanuit deze plaats van opslag? - ingeval van levering van in een andere Lid-Staat verworven goederen wanneer het vervoer naar de eindverwerver in die Lid-Staten begint waar de belastingplichtige niet gevestigd is? - om een eenvoudige belastingbehandeling toe te passen op kettingtransacties, rekening houdend met de belasting op alle intermediaire transacties in de Lid-Staat waar de goederen zich bevinden?
