2. Reasonable compensation shall be due only if the applicant has either communicated to the person using the invention or filed with the Office a translation of the claims which the Office has made available to the public and which is in the official language of the Member State in which the person using the invention has his residence or principal place of business or, where that State has more than one official language, in the language which that person has accepted or designated, provided that the contested use constitutes infringement of the application according to the original text of the application and according to the text of the translation.
2. These two texts are designed to establish a link between the Community trade mark system and the international trade mark registration system of the World Intellectual Property Organisation (WIPO) The aim is to enable enterprises to obtain protection for their trade mark on the basis of the filing of a single application, not only throughout the Community, as a Community trade mark, but also in countries which had signed the Madrid Agreement (such as China).
Deze beide teksten beogen de totstandkoming van een verband tussen het stelsel van het Gemeenschapsmerk en het stelsel voor internationale inschrijving van merken van de Wereldorganisatie voor de intellectuele eigendom (WIPO). Het doel is ondernemingen in staat te stellen door één enkele inschrijving hun merk niet alleen in de gehele Gemeenschap als Gemeenschapsmerk te beschermen, maar ook in de landen die partij zijn bij het Protocol van Madrid (waaronder China).
