By way of exception to paragraph 1, after 1 July 2016, this Article shall apply to roaming providers availing of this Article when those roaming providers demonstrate that they have sought in good faith to establish or extend a bilateral or multilateral roaming agreements on the basis of fair and reasonable terms in all Member States where they do not yet fulfill the requirements of 1 and have been unable to secure any bilateral or multilateral roaming agreement with a roaming provider in one or more Member States, provided they comply with the minimum coverage referred to in paragraph 6(b) and with all other relevant provisions of this Article.

Notwithstanding Article 218(2), (3) and (4), the transitional provisions as referred to in paragraph 14 of this Article shall apply mutatis mutandis at the level of the group and where the participating insurance or reinsurance undertakings or the insurance and reinsurance undertakings in a group comply with the Adjusted Solvency referred to in Article 9 of Directive 98/78/EC but do not comply with the group Solvency Capital Requirement.

3. A person to whom the provisions of Article 50 apply, and his spouse and dependent children accompanying him, shall be covered by the provisions of Article 14 as though they resided in the territory of the Member State in which the said person is seeking a job.
3. Op degene op wie het bepaalde in artikel 50 van toepassing is, alsmede zijn echtgenoot en ten laste komende kinderen, die hem vergezellen, is het bepaalde in artikel 14 van toepassing alsof zij woonden op het grondgebied van de lidstaat waarin de betrokkene werk zoekt.

4a. The provisions of this Article shall apply without prejudice to the provisions laid down in Article 4(1), (2) and (3) of Regulation (EC) No 1049/2001 on public access to documents.
