Member States shall take the measures necessary to ensure that all waste from the titanium dioxide industry, and in particular waste subject to prohibition on discharge or dumping into water or on discharge into the atmosphere is:

It must be borne in mind at the outset that, according to settled case-law, the choice of the legal basis for a Community measure, including one adopted with a view to conclusion of an international agreement, must be based on objective factors which are amenable to judicial review and include in particular the aim and content of the measure (see Case 45/86 Commission v Council, cited above, paragraph 11; Case C-300/89 Commission v Council (the ‘Titanium dioxide case’) [1991] ECR I-2867, paragraph 10; Case C-268/94 Portugal v Council [1996] ECR I‑6177, paragraph 22; Opinion 2/00, cited above, paragraph 22; and Case C‑176/03 Commission v Council [2005] ECR I‑0000, paragraph 45).

By way of exception, if it is established that the measure simultaneously pursues several objectives which are inseparably linked without one being secondary and indirect in relation to the other, the measure may be founded on the corresponding legal bases (see, to that effect, Case C-300/89 Commission v Council [1991] ECR I-2867, paragraphs 13 and 17 (titanium dioxide judgement), and Case C-42/97 Parliament v Council, paragraph 38).

I-2867, paragraphs 13 and 17 (titanium dioxide judgment), and Case C-42/97, Parliament v Council, paragraph 38).

In this regard, your draftswoman would point out, without prejudice to competences or to the decision to be taken by the Legal Affairs Committee and the Fisheries Committee, that the Court of Justice has already held that the EP's participation in the decision-making process 'reflects at Community level the fundamental democratic principle that the peoples should take part in the exercise of power through the intermediary of a representative assembly' (Titanium Dioxide judgment, Case 300/89, paragraph 20) and that it has also held that regular consultation of the EP in the cases provided for by the Treaty constitutes a 'an essential formality disregard of which means that the measure concerned is void' (judgment in Case 138/79 Roquette frères v Council, paragraph 33).
