Council Decision 2007/659/EC of 9 October 2007, adopted on the basis of Article 299(2) of the EC Treaty (now Article 349 TFEU), as amended by Council Decision 896/2011/EU of 19 December 2011 authorises France to apply to 'traditional' rum produced in its overseas departments and sold on the French mainland a reduced rate of excise duty which may be lower than the minimum rate of excise duty set by Directive 92/84/EEC but not more than 50% lower than the standard national excise duty on alcohol.
Bij Beschikking 2007/659/EG van de Raad van 9 oktober 2007, vastgesteld op grond van artikel 299, lid 2, VEG (thans artikel 349 VWEU), als gewijzigd bij Beschikking 896/2011/EU van de Raad van 19 december 2011, wordt Frankrijk gemachtigd in continentaal Frankrijk een verlaagd accijnstarief op in de Franse overzeese departementen vervaardigde "traditionele" rum toe te passen. It was with this in mind that the professional bodies representing producers in the French overseas départements and in the Caribbean countries agreed, in October 2006, at La Barbade, on a common position on the Community definition of rum, taking as the basis for it a generic definition and going on to draw progressive distinctions between traditional rum, agricultural rum and rum refined from sugar.

By letters of 30 August and 13 September 2001 the Council consulted Parliament, pursuant to Article 299 (2) of the EC Treaty, on 1. the proposal for a Council decision authorising France to extend the application of a reduced rate of excise duty on 'traditional' rum produced in its overseas departments (COM(2001) 347 - 2001/0142 (CNS)), and 2. the proposal for a Council decision authorising Portugal to apply a reduced rate of excise duty in the autonomous region of Madeira on locally produced and consumed rum and liqueurs and in the autonomous region of the Azores on locally produced and consumed liqueurs and eaux-de-vie (COM(2001) 442 – 2001/0169(CNS)).

Decision 2002/167/EC of 18 February authorised Portugal to apply a reduced rate of excise duty in the autonomous region of Madeira on locally produced and consumed rum and liqueurs, and in the autonomous region of the Azores on locally produced and consumed liqueurs and eaux-de-vie. [15] Decision 2002/166/EC of 18 February authorised France to extend the application of a reduced rate of excise duty on 'traditional' rum produced in its overseas departments [16].

As for the system applicable to the traditional rum of her overseas departments, France argues that the production of rum has, thanks to this measure in particular, safeguarded the situation and also contributed to maintaining the cane-sugar-rum trade, the importance of which in economic and social terms in the overseas departments makes the measure indispensable.

The Commission has, temporarily, authorised France to apply, on its metropolitan territory, special rates of excise duty on traditional rum, and reduced rates on an annual quota.
