(12) In order to establish that imports of tungstic oxide and tungstic acid from China were being dumped, the Commission had to take account of the fact that China does not have a market economy and it accordingly based its calculations on the normal value of the products in a country with a market economy; to this end, the complainant suggested taking the constructed value calculated on the basis of the cost of production of tungstic oxide in Austria.
(12) Om uit te maken of bij de Chinese invoer van wolfraamoxide en -zuur dumping wordt toegepast, heeft de Commissie in aanmerking moeten nemen dat dit land geen markteconomie heeft; derhalve heeft zij haar berekening moeten baseren op de normale waarde van het betrokken produkt in een land met markteconomie. De indiener van de klacht had voorgesteld uit te gaan van de samengestelde waarde, vastgesteld op basis van de produktiekosten van wolfraamoxide in Oostenrijk.

In the light of the above and the fact that during the reference period approximately 90 % of imports from China falling within CN code ex 2825 90 40 were of tungstic oxide, the Commission considered that tungstic oxide and tungstic acid could be considered like products within the meaning of Article 2 (12) of Regulation (EEC) No 2423/88.

In a notice published in the Official Journal of the European Communities (2), the Commission accordingly announced the initiation of an anti-dumping proceeding concerning imports into the Community of tungstic oxide and tungstic acid falling within CN code 2825 90 40 and originating in the People's Republic of China.

Following the review by the Commission set in hand in 1992 of the measures in force relating to exports from the aforementioned countries, this Regulation introduces anti-dumping measures in respect of Russia (the amount of the duty is equal to the difference between the sum of ECU 115 per tonne and the net free-at-Community frontier price before customs clearance if the latter price is lower) and terminates the anti-dumping procedures in respect of the Czech Republic, the Slovak Republic, Belarus, Georgia, Uzbekistan and Tajikistan; - the Regulation establishing a definitive anti-dumping duty of ECU 352 per tonne on imports of furfuraldehyde (code CN 2932 12 00) originating in the People's Republic of China; - the Regulation extending for two months the provisional anti-dumping duty on imports of tungsten ores and concentrates, tungstic oxide and tungstic acid, tungsten carbide and fused tungsten carbide originating in the People's Republic of China, pending final examination of the facts of this case.
Ingevolge de nieuwe bestudering van de geldende maatregelen voor de uitvoer van de bovengenoemde landen door de Commissie vanaf 1992 worden bij deze verordening anti- dumpingmaatregelen tegen Rusland ingesteld (de hoogte van het bedrag voor Rusland is gelijk aan het verschil tussen de som van 115 ecu per ton en de nettoprijs franco communautaire grens, voor uitslag, indien deze prijs lager is), en worden de anti- dumpingprocedures betreffende de Tsjechische Republiek, Slowaki- je, Wit-Rusland, Georgië, Oezbekistan en Tadzjikistan afgeslo- ten ; - verordening tot instelling van een definitief anti-dumpingrecht op de invoer van furfuraldehyd (code NC 2932 12 00) van oors- prong uit de Volksrepubliek China van 352 ecu per ton ; - verordening tot verlenging van het voorlopige anti-dumpingrecht op de invoer van wolfraamerts en concentraten, wolfraamoxyde, wolfraamzuur, wolfraamcarbide en gesmolten wolfraamcarbide van oorsprong uit de Volksrepubliek China, ten einde de bestudering van de feiten te kunnen afronden.
