‘the law of the Union’ means the Treaty on the Functioning of the European Union; the Treaty on European Union, as well as any acts of the Union referred to in Article 288 paragraph 2, 3 and 4 of the Treaty on the Functioning of the European Union and any international agreements to which the Union is a party or the Union and its Member States are parties; for the sole purposes of this Regulation ‘the law of the Union’ shall not mean the investment protection provisions in the agreement as defined in point (a) of this Article;

‘The provisions of the Agreement that fall within the scope of Title V of Part Three of the Treaty on the Functioning of the European Union bind the United Kingdom and Ireland as separate Contracting Parties, and not as part of the European Union, unless the European Union together with the United Kingdom and/or Ireland have notified the Central American Party that the United Kingdom and/or Ireland are bound as part of the European Union in accordance with the Protocol (No 21) on the position of the United Kingdom and Ireland in respect of the Area of Freedom, Security and Justice, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union.

RECALLING in this regard that the provisions of the Agreement that fall within the scope of Part III, Title V of the Treaty on the Functioning of the European Union bind the United Kingdom and Ireland as separate Contracting Parties, and not as part of the European Union, until the European Union (as the case may be) notifies the Republic of Korea that either State has become bound on these matters as part of the European Union in accordance with the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and the Treaty on the Functioning of the European Union, and that the same applies to Denmark, in accordance with the relevant Protocol annexed to those Treaties;

assisting the Union institutions, bodies, offices and agencies and the Member States in their efforts to collect, analyse and, in line with Member States’ security requirements, disseminate relevant network and information security data; and on the basis of information provided by the Union institutions, bodies, offices and agencies and the Member States in accordance with provisions of Union law and national provisions in compliance with Union law, maintaining the awareness, on the part of the Union institutions, bodies, offices and agencies as well as the Member States of the latest state of network and information security in the Union for their benefit;

Since the objective of this Regulation, namely to establish a European Union Agency for Network and Information Security for the purpose of contributing to a high level of network and information security within the Union and in order to raise awareness and develop and promote a culture of network and information security in society for the benefit of citizens, consumers, enterprises and public sector organisations in the Union, thus contributing to the establishment and proper functioning of the internal market, cannot be sufficiently achieved by the Member States and can therefore be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.
Daar de doelstelling van deze richtlijn, namelijk de oprichting van een Agentschap van de Europese Unie voor netwerk- en informatiebeveiliging, met als doel bij te dragen aan een hoog niveau van netwerk en informatieveiligheid binnen de Unie en om de bewustzijn te versterken en om een cultuur van netwerk en informatieveiligheid aan te moedigen ten behoeve van burgers, consumenten, ondernemingen en organisatie in de publieke sector binnen de Unie, niet voldoende door de lidstaten kan worden verwezenlijkt en derhalve beter op het niveau van de Unie kan worden bereikt, kan de Unie overeenkomstig het subsidiariteitsbeginsel van artikel 5 van het Verdrag betreffende de Europese Unie maatregelen vaststellen.

J. whereas, notwithstanding this, with the Union's accession to the ECHR, the Union may over time have to find a common yardstick in cross-border cases relating to the freedoms to supply goods and services as a result of the ‘dialectical development’ looked forward to by Advocate General Mancini in the Bond van Adverteerders case, having regard also to the judgments in Elliniki Radiofonia Tileorasi and Society for the Protection of Unborn Children Ireland Ltd and Advocate General Jacobs' opinion in Christos Konstantinidis ; indeed, in the case Society for the Protection of Unborn Children Ireland Ltd , Advocate General Van Gerven put forward the proposition that ‘a national rule which in order to show that it is compatible with [Union] law has to rely on legal concepts, such as imperative requirements of public interest or public policy .falls ’within the scope' of [Union] law' on the ground that, although the Member States have some discretion in defining the public interest or public policy concepts, the scope of those concepts in the case of measures falling within the scope of Union law is nevertheless subject to Union control and they have to be ‘justified and delimited in a uniform manner for the whole [Union] under [Union] law and therefore taking into account the general principles in regard to fundamental rights and freedoms’;

9. Insists on the preservation of all basic principles as contained in Part I of the Constitutional Treaty, including the dual nature of the European Union as a union of States and of citizens, the primacy of the European law, the new typology of acts and procedures, the hierarchy of norms, and the legal personality of the European Union; stresses that the Constitutional Treaty also brings about other important improvements in matters such as consolidation of the existing Treaties and the merging of pillars, the express recognition of the values on which the European Union is based and of the legally binding force of the Charter of Fundamental Rights, as well as enhancing the participation of citizens in the political life of the European Union, clarification of the respective competencies of the European Union and of the Member States, respect for the principle of subsidiarity and the specific role of national parliaments in this matter, without jeopardising the institutional balance of the European Union, as enshrined in the protocol on subsidiarity, and respect for the role of regional and local authorities;
9. dringt aan op behoud van alle grondbeginselen zoals die vervat zijn in deel I van het Grondwettelijk Verdrag, met inbegrip van de dubbele aard van de Europese Unie als een unie van staten en een unie van burgers, het primaat van de Europese wetgeving, de nieuwe typologie van wetgeving en procedures, de wetgevingshiërarchie en de rechtspersoonlijkheid van de Europese Unie; en beklemtoont dat het Grondwettelijk Verdrag ook andere belangrijke verbeteringen meebrengt ten aanzien van onderwerpen als consolidering van de bestaande verdragen en de samenvoeging van pijlers, de uitdrukkelijke erkenning van de waarden waarop de Europese Unie is gegrondvest en het wettelijk bindende karakter van het Handvest van de grondrechten, alsmede ten aanzien van de bevordering van de participatie van burgers in het politieke leven van de Europese Unie, verduidelijking van de respectieve bevoegdheden van de Europese Unie en de lidstaten, inachtneming van het subsidiariteitsbeginsel, en de specifieke rol van nationale parlementen op dit gebied zonder het institutionele evenwicht van de Europese Unie in gevaar te brengen, zoals vastgelegd in het protocol betreffende de toepassing van het subsidiariteitsbeginsel, en eerbiediging van de rol van regionale en lokale autoriteiten;
