The eight Arctic states, which are the permanent members of the Arctic Council – the central international and intergovernmental organizations of the region – view UNCLOS as the only comprehensive multilateral regime that applies to the Arctic and have opposed the idea of concluding an international treaty on the Arctic modelled on the Antarctica Treaty of 1959.

Having regard to those facts, it becomes clear that the idea of an Arctic Treaty, modelled along the Treaty for the continent of Antarctica, thus land not sea, uninhabited and unclaimed compared to inhabited and state controlled in the Arctic, is not only not promoted by the peoples and states in the Arctic, but also wouldn’t be an appropriate way to deal with the challenges in the Arctic.

Welcomes the fact that the third international conference aiming at the conclusion of an international treaty prohibiting the production, use, transfer or storage of cluster bombs in accordance with the principles of IHL was held in Vienna in December 2007 with the full support of the European Union ; calls on Romania and Cyprus, as the only two EU Member States that have not yet done so, to endorse the Oslo Declaration on Cluster Munitions of 23 February 2007; fully supports the Oslo process conferences held in Wellington from 18 to 22 February 2008 and fixed to take place in Dublin from 19 to 30 May 2008; expects that all European Union Member States will be able to sign the treaty at the ceremony planned to be held in Oslo in late 2008;

(d) affect the provision of Article IV, paragraph 2, of the Antarctic Treaty that no new claim, or enlargement of an existing claim, to territorial sovereignty in Antarctica shall be asserted while the Antarctic Treaty is in force.
d) mag afbreuk doen aan de in artikel IV, lid 2, van het Verdrag inzake Antarctica vervatte bepaling dat zolang het Verdrag inzake Antarctica van kracht is, geen nieuwe aanspraken of uitbreidingen van reeds bestaande aanspraken op territoriale soevereiniteit in Antarctica geldend kunnen worden gemaakt.

RECOGNIZING the prime responsibilities of the Antarctic Treaty Consultative Parties for the protection and preservation of the Antarctic environment and, in particular, their responsibilities under Article IX, paragraph 1 (f) of the Antarctic Treaty in respect of the preservation and conservation of living resources in Antarctica;
