Donations of pharmaceutical products and products sold under contracts awarded in response to competitive tenders from national governments or international procurement bodies, or under a partnership agreed between the manufacturer and the government of a country of destination should be able to qualify under this Regulation on equal conditions, bearing in mind that donations do not contribute to the improvement of access to such products on a sustainable basis.

Q. whereas the use of tissues and cells for application in the human body carries a risk of transmission of disease to recipients; whereas that risk can be reduced by careful donor selection, an evaluation of potential donors prior to procurement based on a risk/benefit analysis, testing and monitoring of each donation and the application of procedures to procure tissues and cells in accordance with rules and processes established and updated according to the best available scientific advice;

Sharing such information between Member States would facilitate further improvement of donation and transplantation across the Union. As emphasised by the Recommendation Rec(2006)15 of the Committee of Ministers of the Council of Europe to Member States on the background, functions and responsibilities of a National Transplant Organisation (NTO), it is preferable to have a single non-profit making body which is officially recognised with overall responsibility for donation, allocation, traceability and accountability.

Urges the Member States to adopt or maintain strict legal provisions in connection with transplantation from unrelated living donors, in order to make the system transparent and exclude the possibility of illicit organ selling or coercion of donors; thus, donations by unrelated living donors only being permitted to be made under the conditions defined in national law and following authorisation by a suitable independent body;
23. verzoekt de lidstaten met klem strenge wettelijke voorschriften aan te nemen of te handhaven als het gaat om transplantatie van niet-verwante levende donoren, om het systeem transparant te maken en de mogelijkheid van onwettige orgaanverkoop of dwang van donoren uit te sluiten; donaties door niet-verwante levende donoren zouden dan uitsluitend mogelijk zijn volgens de in de nationale wetgeving vastgelegde voorwaarden en met toestemming van een geschikte onafhankelijke instantie;
