Met betrekking tot artikel 23 van het voorstel van de heer Vandenberghe staat er verder nog in de toelichting : « Aldus zijn enkel de Nederlandstalige rechtbanken bevoegd voor de zaken waarvoor de bevoegdheid wordt bepaald door een plaats op het grondgebied Halle-Vilvoorde» (stuk Senaat, nr. 3-159/1, blz. 17) In het algemene deel van de toelichting leest men bovendien : « Aldus worden alle Nederlandstalige zaken behandeld door een Nederlandstalige rechtbank, die territoriaal bevoegd is voor het grondgebied Halle-Vilvoorde-Brussel-Hoofdstad; de Franstalige zaken door een Franstalige rechtbank, die territoriaal bevoegd is voor het grondgebied Brussel-Hoofdstad : een horizontale, asymmetrische splitsing» (id., blz. 5).

En effet, les affaires néerlandophones seront instruites par un tribunal néerlandophone, territorialement compétent pour le territoire de Hal-Vilvorde et de Bruxelles-Capitale, tandis que les affaires francophones seront instruites par un tribunal francophone, territorialement compétent pour le territoire de Bruxelles-Capitale.
Nederlandstalige zaken zullen immers behandeld worden door een Nederlandstalige rechtbank, die territoriaal bevoegd is voor het grondgebied Halle-Vilvoorde en Brussel-Hoofdstad, terwijl de Franstalige zaken door een Franstalige rechtbank worden behandeld die territoriaal bevoegd is voor Brussel-Hoofdstad.

M. Vanlouwe répond qu'il faut lire également ce qui figure au point 3 des développements précédant la proposition en question: « Toutes les affaires néerlandophones seront ainsi instruites par un tribunal néerlandophone, territorialement compétent pour le territoire de Hal-Vilvorde-Bruxelles-Capitale, les affaires francophones étant instruites par un tribunal francophone, territorialement compétent pour le territoire de Bruxelles-Capitale: il s'agit d'une scission, horizontale, asymétrique » (doc. Sénat, nº 3-159/1, p. 5, 3.1.1).
