Ce principe est d'ailleurs explicitement reconnu dans la Recommandation n° 1 du Comité de Bâle sur le contrôle bancaire (« Core Principles for Effective Banking Supervision « , Basel Committee on Banking Supervision, Basel, www.bis.org) et a en outre validé en droit comparé, plusieurs pays limitrophes ayant en effet légiféré en ce sens.
