In dit verband heeft het Hof geoordeeld dat het beginsel van gelijke behandeling een algemeen beginsel van Unierecht is dat in de artikelen 20 en 21 van het Handvest is verankerd en dat vereist dat vergelijkbare situaties niet verschillend en verschillende situaties niet gelijk worden behandeld, tenzij dit objectief gerechtvaardigd is (zie met name arrest van 14 september 2010, Akzo Nobel Chemicals en Akcros Chemicals/Commissie e.a., C-550/07 P, EU: C: 2010: 512, punten 54 en 55 en aldaar aangehaalde rechtspraak).

À la suite d'un recours en annulation contre plusieurs décisions de la Commission déposé par Akzo Nobel et Akcros Chemicals en avril 2003, le litige concernant les documents a été résolu par le Tribunal de première instance (maintenant le Tribunal) dans son arrêt du 17 septembre 2007.
