Dans leur commentaire sur l'un des arrêts phares la Cour européenne des droits de l'homme, à savoir l'affaire S.W. contre Grande-Bretagne du 22 novembre 1995, Lawson et Schermers affirment ce qui suit (4) : « Expanding upon the reference in Article 7 § 1 of the European Convention on Human Rights to « crimes .under international law », paragraph 2 of Article 7 makes it possible to punish a person for an act which, at the time it was committed, was « criminal according to the general principles of law recognised by civilised nations », even though it was not classified as a criminal offence under national law.
