Les vols effectués au cours de la procédure de certification et qui ne peuvent être assimilés à des opérations commerciales normales ne doivent pas entrer dans le champ d'application de la directive. Where an owner of an aircraft is required to, for example, repossess an aircraft from a lessee and/or sub-lessee operator following the occurrence of a sudden termination event, event of default or similar occurrence, the “ferry flights” of such aircraft undertaken by or on behalf of the aircraft's owner to recover the aircraft resulting from such circumstances should be excluded from the list of relevant aviation activities, otherwise the significant administrative requirements of the proposed scheme will place a disproportionate burden and financial risk on aircraft owners that are forced to carry out "ferry flights" in such circumstances.
Vluchten die gedurende de certificatieprocedure plaatsvinden en die niet te vergelijken zijn met normale commerciële vluchten, dienen buiten het toepassingsgebied van de richtlijn te vallen. Indien de eigenaar van een vliegtuig na een plotselinge beëindigingsgebeurtenis, bij in gebreke blijven of soortgelijke gebeurtenissen bij voorbeeld een vliegtuig terug moet nemen van een exploitant die van hem pacht en/of onderpacht, moeten de hieruit voortkomende overbrengingsvluchten van deze vliegtuigen die door of namens de eigenaar worden uitgevoerd om het vliegtuig terug te krijgen, uitgesloten worden van de lijst van desbetreffende luchtvaartactiviteiten. Zo niet, dan worden ten gevolge van de omvangrijke administratieve eisen in de voorgestelde regeling onevenredige lasten en financiële risico's neergelegd bij de vliegtuigeigenaars, die in dergelijke omstandigheden gedwongen zijn overbrengingsvluchten uit te voeren.
