H. considérant que, si les institutions de l'Union ignorent encore le contenu des "modalités d'application", il ressort clairement des protocoles d'accord que certaines des nouvelles conditions à respecter en matière de sécurité relèvent de la compétence de la Communauté (telles celles concernant la délivrance de visas ou les futures obligations complémentaires du système d'autorisation de voyage électronique (ESTA - Electronic System Travel Authorization), que d'autres relèvent de la compétence de l'Union (passeports volés , données PNR, données Schengen en matière de criminalité), et que le reste d'entre elles relèvent de la compétence exclusive de chaque État membre (casier judiciaire des ressortissants ou présence de policiers de l'air sur les vols transatlantiques),
