Vluchten die gedurende de certificatieprocedure plaatsvinden en die niet te vergelijken zijn met normale commerciële vluchten, dienen buiten het toepassingsgebied van de richtlijn te vallen. Indien de eigenaar van een vliegtuig na een plotselinge beëindigingsgebeurtenis, bij in gebreke blijven of soortgelijke gebeurtenissen bij voorbeeld een vliegtuig terug moet nemen van een exploitant die van hem pacht en/of onderpacht, moeten de hieruit voortkomende overbrengingsvluchten van deze vliegtuigen die door of namens de eigenaar worden uitgevoerd om het vliegtuig terug te krijgen, uitgesloten worden van de lijst van desbetreffende luchtvaartactiviteiten. Zo niet, dan worden ten gevolge van de omvangrijke administratieve eisen in de voorgestelde regeling onevenredige lasten en financiële risico's neergelegd bij de vliegtuigeigenaars, die in dergelijke omstandigheden gedwongen zijn overbrengingsvluchten uit te voeren.
