3. wijst op het arrest Royal Society for the Protection of Birds (HvJ, 11 juli 1996, Royal Society for the Protection of Birds, C-44/95, Jurispr. blz. I - 3805), waarin wordt gesteld dat uit artikel 6 van de habitatrichtlijn (richtlijn 92/43 inzake de instandhouding van de natuurlijke habitats en de wilde flora en fauna) volgt dat wijziging van speciale beschermingszones mag plaats vinden om onder meer economische overwegingen;
3. verweist auf das Urteil des EuGH vom 11. Juli 1996 in der Rechtssache C-44/95 "Royal Society for the Protection of Birds" (Slg. Rechtsprechung S. I-3805), demzufolge aus Artikel 6 der Habitat-Richtlinie (Richtlinie 92/43 zur Erhaltung der natürlichen Lebensräume sowie der wildlebenden Tiere und Pflanzen) hervorgeht, daß eine Änderung der besonderen Schutzgebiete u.a. mit Rücksicht auf wirtschaftliche Erfordernisse zulässig ist;
