Deze perceptie is echter gewijzigd met de Laval-uitspraak, waarin het hof verklaart dat artikel 3(7) in de terbeschikkingstellingsrichtlijn “cannot be interpreted as allowing the host Member State to make the provision of services in its territory conditional on the observance of terms and conditions of employment which go beyond the mandatory rules for minimum protection”.
Diese Auslegung ändert sich jedoch mit dem Laval-Urteil, in dem der Gerichtshof erklärt, dass sich Artikel 3 Absatz 7 der Entsenderichtlinie „nicht dahin auslegen lässt, dass er es einem Aufnahmemitgliedstaat erlaubt, die Erbringung einer Dienstleistung in seinem Hoheitsgebiet davon abhängig zu machen, dass Arbeits- und Beschäftigungsbedingungen eingehalten werden, die über die zwingenden Bestimmungen über ein Mindestmaß an Schutz hinausgehen“.

Derhalve verzoek ik deze passage zo te veranderen als wij hem hebben aangenomen. Daher bitte ich, diesen Teil so zu ändern, wie wir ihn schon beschlossen haben.
