TRADUCTIONS EN CONTEXTE

In deze context zij ook gewezen op het verzoek van het Europees Parlement, in het kader van het debat over een wijziging van de "Audiovisual Media Services"-richtlijn (AVMS)[11] richtlijn, betreffende de invoering van een gedragscode voor op kinderen gerichte reclame voor levensmiddelen met een hoog gehalte aan vet of suiker.
In such a context the request of the European Parliament, regarding the introduction of a code of conduct for advertising of food high in fat or sugars aimed at children during the debate on a modification of the "Audiovisual Media Services" (AVMS)[11] Directive, has to be underlined.

De mededeling sluit met name aan op de bepalingen van de AVMS-richtlijn (de mededeling zal onderzoek aanmoedigen van de criteria om mediageletterdheid te beoordelen, hetgeen een eerste stap is op weg naar de verplichting (om verslag uit te brengen) van artikel 26[6] en het MEDIA 2007-programma.
In particular, it links to the provisions of the AVMS Directive (the Communication will encourage research into criteria for assessing media literacy which are a first step towards the Art. 26 reporting obligation)[6] and the MEDIA 2007 programme.

The new Audiovisual Media Services Directive (AVMS), for example, sets out a reporting obligation for the Commission to measure levels of media literacy in all the Member States[1].

The new AVMS Directive foresees that media service providers should be encouraged by the Member States, and by the Commission, to develop codes of conduct regarding commercial communication on food and beverages targeted at children.

Stresses that the ‘country of origin’ principle enshrined in the AVMS Directive is a necessary prerequisite for the provision of audiovisual content across borders and a milestone on the way to a common market in services; emphasises that it does not prevent the achievement of social and cultural objectives and that it does not preclude the need to adapt EU law outside the AVMS Directive to the realities of the internet and the digital environment, nor the need to pay special attention to companies offering audiovisual content on line or on demand that try to evade taxation and audiovisual regulation in certain Member States by basing themselves in countries with a very low tax rate or weak audiovisual regulation;

63. benadrukt dat het herkomstlandbeginsel dat in de AVMS-richtlijn is neergelegd een noodzakelijke voorwaarde vormt voor het grensoverschrijdend aanbieden van audiovisuele inhoud, op de weg naar een gemeenschappelijke markt voor diensten; onderstreept tegelijkertijd dat dit beginsel het streven naar sociale en culturele doelstellingen niet in de weg staat en niet de noodzaak wegneemt om andere EU-wetgeving dan de AVMS-richtlijn aan te passen; benadrukt dat het om de praktijk van "forum shopping" te bestrijden nodig is dat het land van herkomst van de reclameopbrengsten, de taal van de dienst en de doelgroep van de reclame en de inhoud deel moeten uitmaken van de criteria op basis waarvan het "land van herkomst" van een audiovisuele mediadienst wordt bepaald of aangevochten;
63. Stresses that the ‘country of origin’ principle enshrined in the AVMS Directive is a necessary prerequisite for the provision of audiovisual content across borders on the way to a common market in services; underlines, at the same time, that this principle does not prevent the achievement of social and cultural objectives and that it does not preclude the need to adapt EU law outside the AVMS Directive; stresses that in order to fight the practice of ‘forum shopping’, the country of origin of the advertising profit, the language of the service and the targeted public of the advertisement and content should be part of the criteria to determine or contest the ‘country of origin’ of an audiovisual media service;

49. herinnert eraan dat de Commissie naar aanleiding van de door het Parlement en de lidstaten ingenomen standpunten heeft ingestemd met het beginsel van de "culturele uitzondering" , zoals neergelegd in het VN-verdrag betreffende de culturele diversiteit, volgens hetwelk cultuur anders moet worden behandeld dan andere commerciële producten en cultuurgoederen en -diensten hoofdzakelijk buiten de onderhandelingen moeten worden gehouden; is van mening dat dit ook moet gelden voor de audiovisuele mediadiensten (AVMS) en de hoofdpunten van de richtlijn audiovisuele mediadiensten, overheidssubsidies, financieringsverplichtingen voor omroepen (met name om de productie en distributie van Europese films te ondersteunen), overeenkomsten inzake coproducties, maatregelen ten aanzien van het taalbeleid, de werking van kanalen met een openbaredienstenmandaat, het bestaan van plafonds voor het eigendom (in de vorm van aandelen) in kanalen en netwerken, de intellectuele-eigendomsrechten in de culturele, journalistieke en wetenschappelijke sfeer en specifieke socialezekerheidsstelsels;
49. Recalls, that following the Member States’ and Parliament’s position, the Commission agreed on the principle of the ‘cultural exception’, as contained in the UN convention on cultural diversity, according to which culture should be treated differently from other commercial products, and cultural goods and services should be mainly left out of the negotiations; takes the view that this should include Audiovisual Media Services (AVMS) and the main issues of the AVMS Directive, public subsidies, financing obligations for broadcasters (especially to support European movie productions and distribution), co-production agreements, language policy measures, the functioning of channels invested with a public-service remit, the existence of stockholding caps in channels and networks, intellectual property rights in the cultural, journalistic and scientific sphere and specific social-security systems;

3. dringt er bij de Commissie op aan een aanbeveling goed te keuren en een actieplan op te stellen inzake mediageletterdheid; verzoekt de Commissie met klem om in de loop van het jaar 2009 een bijeenkomst van het contactcomité AVMS (audiovisuele mediadiensten) te organiseren met als doel te komen tot regelmatige informatie-uitwisseling en efficiënte samenwerking;
3. Urges the Commission to adopt a recommendation, and develop an action plan, on media literacy; urges the Commission to organise a meeting of the contact committee on Audio-Visual Media Services in 2009 with a view to facilitating information exchanges and effective cooperation on a regular basis;
