12. Takes note of the statement made by the Prosecutor of the ICTY before the United Nations Security Council (UNSC) on 6 December 2010; welcomes the generally responsive attitude of Croatia's authorities to the Prosecutor's requests for assistance and the fact that requests are answered adequately and access to witnesses and evidence is provided; calls on the Croatian Government, however, to intensify its administrative investigation concerning the requested military documents and clarify inconsistencies in its reports to the Prosecutor's Office that were mentioned in the Prosecutor's latest statement to the UNSC and have not been resolved yet;

11. herinnert eraan dat volledige samenwerking met het Internationaal Straftribunaal voor het voormalige Joegoslavië (ICTY) een conditio sine qua non is voor Servië om de weg naar het EU-lidmaatschap verder te kunnen bewandelen; constateert dat Servië nog steeds adequaat reageert op bijstandsverzoeken van het ICTY en verzoekt de Servische regering nauw te blijven samenwerken met het Straftribunaal, ook wat betreft een snelle overlegging van alle aangevraagde documenten en een tijdige afsluiting van zaken die door het ICTY zijn terugverwezen; wijst echter op het meest recente oordeel van de hoofdaanklager van het ICTY dat de inspanningen van Servië om de twee resterende voortvluchtigen gevangen te nemen problematisch blijven; benadrukt dat alleen gevangenneming en uitlevering van de voortvluchtigen aan Den Haag kunnen worden beschouwd als het meest overtuigende bewijs voor volledige samenwerking en dringt aan op meer systematische inspanningen om de voortvluchtigen aan te houden zodat het mandaat van het tribunaal eindelijk kan worden vervuld; dringt met name aan op een herziening van de huidige aanpak, in lijn met de aanbevelingen van het ICTY; benadrukt dat Servië alleen de status van kandidaat-lidstaat kan krijgen en/of toetredingsonderhandelingen met de EU kan beginnen als het Bureau van de aanklager van het ICTY van oordeel is dat Servië volledige samenwerking heeft aangeboden;
11. Recalls that full cooperation with ICTY is a fundamental condition for Serbia to progress on the path to EU membership; notes that Serbia continues to respond adequately to ICTY requests for assistance and calls on the Serbian Government to continue working closely with the Court, including swift transmission of all requested documents and timely completion of cases transferred back from ICTY; points out, however, the most recent assessment by the ICTY Chief Prosecutor that Serbia's efforts to apprehend the two remaining fugitives continue to be problematic; underlines that only apprehension and extradition of the fugitives to The Hague can be deemed the most convincing evidence of full cooperation and calls for more systematic efforts to arrest them so that the mandate of the Court can be finally fulfilled; in particular, urges a re-evaluation of the current approach, in line with the ICTY recommendations; emphasises that Serbia can only gain candidate status and/or open accession negotiations with the EU if the ICTY Office of the Prosecutor assesses that it has offered full cooperation;

5. De Raad verzoekt Servië uitvoering te geven aan de in juni 2010 door de openbaar aanklager van het ICTY aan de Veiligheidsraad van de Verenigde Naties verstrekte aanbevelingen betreffende ondersteuning door Servië in lopende processen en beroepszaken en hulp van Servië in de cruciale kwestie van de arrestatie van de twee resterende vluchtelingen, Ratko Mladic en Goran Hadzic; dat zou het meest overtuigende bewijs zijn dat Servië zich inspant om mee te werken met het ICTY.
5. The Council calls upon Serbia to implement recommendations presented by the ICTY Office of the Prosecutor to the United Nations Security Council in June 2010 concerning Serbia’s support in ongoing trials and appeals and Serbia’s assistance in the key matter of the arrest of the two remaining fugitives, Ratko Mladic and Goran Hadzic, which would be the most convincing proof of Serbia's efforts and cooperation with the ICTY".

In een brief aan het voorzitterschap van 7 juni 2005 stelt de openbaar aanklager van het ICTY vast dat Kroatië door de uitvoering van zijn actieplan vorderingen heeft gemaakt die tot een volledige samenwerking met het ICTY kunnen leiden, maar dat pas over drie tot vier maanden kan worden beoordeeld of die nieuwe inspanningen concrete resultaten hebben opgeleverd.
In his letter to the Presidency on 7 June 2005, the ICTY Chief Prosecutor noted that by implementing its action plan, Croatia was on the road to full cooperation with the ICTY but that three to four months were required to determine whether these further efforts had produced tangible results.

De Raad neemt er nota van dat de aanklager van het ICTY als zijn mening te kennen heeft gegeven dat de situatie in Kosovo een gewapend conflict is in de zin van het mandaat van het Tribunaal.
