IN-CONTEXT TRANSLATIONS

Om afschrikking en consistente toepassing van de sancties in alle lidstaten te waarborgen, moet deze verordening voorzien in een lijst van de voornaamste administratieve sancties en andere maatregelen waarover de bevoegde autoriteiten moeten kunnen beschikken, in de bevoegdheid om die sancties en andere maatregelen op te leggen aan alle natuurlijke of rechtspersonen die verantwoordelijk zijn voor een inbreuk, in een lijst van belangrijke criteria bij het bepalen van het niveau en de soort van sancties en andere maatregelen en in niveaus van administratieve geldboetes.
In order to provide deterrence and consistent application of the sanctions across Member States, this Regulation should provide a list of key administrative sanctions and other measures that need to be available to the competent authorities, for the power to impose those sanctions and other measures on all persons, whether legal or natural, responsible for an infringement, for a list of key criteria when determining the level and type of those sanctions and other measures and for levels of administrative pecuniary sanctions.

Bij Verordening (EU) nr. 1024/2013 heeft de ECB een aantal toezichttaken gekregen, alsmede de bevoegdheid om kredietinstellingen die onder toezicht van de bank staan: a) administratieve geldelijke sancties op te leggen wanneer deze instellingen een inbreuk plegen op een krachtens rechtstreeks toepasselijk Unierecht geldend voorschrift waarvoor administratieve geldelijke sancties aan de bevoegde autoriteiten beschikbaar gesteld moeten worden krachtens het toepasselijk Unierecht, en b) sancties overeenkomstig Verordening (EG) nr. 2532/98 wanneer een inbreuk op verordeningen of besluiten van de ECB wordt gepleegd (hierna gezamenlijk „administratieve sancties”).
Regulation (EU) No 1024/2013 vested the ECB with some supervisory tasks and entitled the latter to impose on the credit institutions it supervises: (a) administrative pecuniary penalties when these institutions breach a requirement under directly applicable Union law in relation to which administrative pecuniary sanctions shall be made available to competent authorities under the relevant Union law; and (b) sanctions in accordance with Regulation (EC) No 2532/98 in case of a breach of ECB regulations or decisions (hereinafter jointly referred to as ‘administrative penalties’).

In order to ensure that the new legal framework established by that Regulation functions smoothly and applies uniformly, the Commission has been empowered to adopt certain rules in relation to administrative and on-the-spot checks, the measurement of areas, the cases in which aid applications or payment claims may be corrected, the application and calculation of partial or total withdrawals and the recovery of undue payments and penalties, the application and calculation of administrative penalties, the requirements for the computerised database, aid applications and payment claims and applications for payment entitlements, including the final date for submission, the carrying-out of checks, transfers of holdings, payments of advances, the carrying-out of checks relating to cross-compliance obligations, the calculation and application of administrative penalties in cross-compliance and technical specifications necessary for the purpose of the uniform application of the basic rules on the integrated administration and control system (‘integrated system’) as regards cross-compliance.

Therefore, administrative sanctions and other administrative measures laid down by Member States should satisfy certain essential requirements in relation to addressees, criteria to be taken into account when applying a sanction or other administrative measure, publication of sanctions or other administrative measures, key penalising powers and levels of administrative fines.

2. Bij de uitoefening van hun bevoegdheden om uit hoofde van artikel 30 administratieve sancties en andere administratieve maatregelen op te leggen, werken de bevoegde autoriteiten nauw samen om ervoor te zorgen dat de toezichts- en onderzoeksbevoegdheden en de administratieve sancties die zij opleggen, en de andere administratieve maatregelen die zij nemen, uit hoofde van deze verordening, doeltreffend en passend zijn.
2. In the exercise of their powers to impose administrative sanctions and other administrative measures under Article 30, competent authorities shall cooperate closely to ensure that the exercise of their supervisory and investigative powers, and the administrative sanctions that they impose, and the other administrative measures that they take, are effective and appropriate under this Regulation.
