(14) Overwegende dat, hoewel het bij deze richtlijn advocaten wordt toegestaan onder hun oorspronkelijke beroepstitel hun beroep in een andere lidstaat uit te oefenen, het doel ook de vergemakkelijking van het verkrijgen van de beroepstitel van de lidstaat van ontvangst is; dat de lidstaat van ontvangst op grond van de artikelen 48 en 52 van het Verdrag in de door het Hof van Justitie daarvan gegeven uitlegging te allen tijde gehouden is met de reeds op het grondgebied van deze lidstaat verworven beroepservaring rekening te houden; dat na drie jaar daadwerkelijke en regelmatige beroepsuitoefening in de lidstaat van ontvangst in het recht van die lidstaat, met inbegrip van het Gemeenschapsrecht, redelijkerwijs valt aan te nemen dat deze advocaten de noodzakelijke bekwaamheid hebben verworven om zich volledig in de advocatuur van de lidstaat van ontvangst te kunnen integreren; dat de advocaat na deze periode de beroepstitel van de lidstaat van ontvangst moet kunnen verkrijgen, indien hij, onder voorbehoud van verificatie, kan aantonen aldaar beroepservaring te hebben opgedaan; dat, wanneer de periode van daadwerkelijke en regelmatige beroepsuitoefening van ten minste drie jaar een kortere periode in het recht van de lidstaat van ontvangst omvat, de autoriteit tevens alle andere kennis van dit recht in aanmerking neemt en deze kennis tijdens een onderhoud kan toetsen; dat, als het bewijs dat aan deze voorwaarden wordt voldaan, niet is geleverd, het besluit van de bevoegde autoriteit van die lidstaat om de beroepstitel van die lidstaat niet via de aan die voorwaarden verbonden gunstige regeling te verlenen, met redenen omkleed en volgens het nationale recht voor beroep bij de rechter vatbaar moet zijn;
(14) Whereas the purpose pursued by this Directive in enabling lawyers to practise in another Member State under their home-country professional titles is also to make it easier for them to obtain the professional title of that host Member State; whereas under Articles 48 and 52 of the Treaty as interpreted by the Court of Justice the host Member State must take into consideration any professional experience gained in its territory; whereas after effectively and regularly pursuing in the host Member State an activity in the law of that State including Community law for a period of three years, a lawyer may reasonably be assumed to have gained the aptitude necessary to become fully integrated into the legal profession there; whereas at the end of that period the lawyer who can, subject to verification, furnish evidence of his professional competence in the host Member State should be able to obtain the professional title of that Member State; whereas if the period of effective and regular professional activity of at least three years includes a shorter period of practice in the law of the host Member State, the authority shall also take into consideration any other knowledge of that State's law, which it may verify during an interview; whereas if evidence of fulfilment of these conditions is not provided, the decision taken by the competent authority of the host State not to grant the State's professional title under the facilitation arrangements linked to those conditions must be substantiated and subject to appeal under national law;

ANDERE BESLUITEN (Zonder debat aangenomen) Uitbouw en werking van het Europees Milieuagentschap - Conclusies van de Raad "DE RAAD, NA AKTE TE HEBBEN GENOMEN VAN HET FEIT dat artikel 20 van Verordening (EEG) nr. 1210/90 van de Raad van 7 mei 1990 [6] bepaalt dat uiterlijk twee jaar na de inwerkingtreding van de verordening op basis van een verslag van de Commissie een besluit moet worden genomen over de verdere taken van het Agentschap ; dat de verordening overeenkomstig artikel 21 in werking is getreden op 30 oktober 1993, de dag na het besluit van de bevoegde autoriteiten om de zetel van het Agentschap in Kopenhagen te vestigen ; NA TEVENS NOTA TE HEBBEN GENOMEN VAN HET FEIT dat het Agentschap pas medio 1994 zijn werkzaamheden heeft aangevat en pas eind 1995 een volledig personeelsbestand zal hebben ; dat het wenselijk zou zijn om het Agentschap ten minste twee jaar ten volle te laten functioneren, alvorens een besluit te nemen over de eventuele toewijzing van verdere taken ; MEMOREREND dat de artikelen 2 en 4 van de verordening voorzien in de totstandbrenging van een netwerk van organisaties in de Lid-Staten die kunnen bijdragen tot de tenuitvoerlegging van de taken van het Agentschap ; TEVENS MEMOREREND dat krachtens artikel 19 van de verordening het Agentschap open staat voor landen die geen lid zijn van de Europese Gemeenschap, maar met de Gemeenschap een overeenkomst hebben gesloten volgens de procedure van artikel 228 van het Verdrag ; 1. VERHEUGT ZICH OVER EN STEUNT de mededeling van de Commissie betreffende het onderzoek naar de verdere uitwerking en de tenuitvoerlegging van Verordening (EEG) nr. 1210/90 van de Raad inzake de oprichting van het Europees Milieuagentschap (EMA) en het Europees Milieuobservatie- en - informatienetwerk (EIONET).
MISCELLANEOUS DECISIONS (Adopted without debate) Development and implementation of the European Environment Agency - Council Conclusions "THE COUNCIL HAVING NOTED that Council Regulation (EEC) No 1210/90 of 7 May 1990 [6] makes provision in its Article 20 for a decision on further tasks for the Agency, based on a Report from the Commission, no later than two years after the entry into force of the Regulation; that, in accordance with Article 21, the Regulation came into force on 30 October 1993, the day following the decision of the competent authorities to locate the seat of the Agency in Copenhagen; HAVING FURTHER NOTED that the Agency started to operate only in mid-1994 with its full staff not in post until the end of 1995 and that it would be desirable to allow the Agency at least two fully operational years before a decision is made on the assignment of further tasks to it; RECALLING that Articles 2 and 4 of the Regulation provide for the building of a network of organizations in its member countries which can contribute to the completion of the tasks of the Agency; FURTHER RECALLING that Article 19 of the Regulation opens the Agency to countries which are not members of the European Communities which conclude an agreement with the Community following the procedure in Article 228 of the Treaty, 1.
