Welcomes the recent legislative and judicial decisions taken in the US to limit mass surveillance by the NSA, including the adoption of the USA Freedom Act in Congress without any amendments as the result of bicameral and bipartisan compromise, and the ruling of the Second Circuit Court of Appeals on the NSA’s telephone record collection programme; regrets, however, the fact that these decisions focus mainly on US persons while the situation of EU citizens remains the same;

Daar het Gerecht van oordeel was dat het zonder mondelinge behandeling uitspraak kon doen, is partijen bij schrijven van de griffie van 16 juni 2011 verzocht om het Gerecht mee te delen of zij het al dan niet eens waren met het voorstel om de zaak op grond van artikel 48, lid 2, van het Reglement voor de procesvoering zonder terechtzitting af te doen.
Since the Tribunal considered that it was in a position to proceed to judgment without a hearing, the parties were requested, by letter from the Registry of 16 June 2011, to inform the Tribunal whether they agreed or not to the Tribunal’s proposal to proceed to judgment without a hearing, in pursuance of Article 48(2) of the Rules of Procedure.

Underlines the importance of achieving a just and lasting peace in the Middle East, and between Israelis and Palestinians in particular; calls on both parties to resume direct negotiations without delay, in the framework of the agreed roadmaps to peace, to reach a comprehensive agreement based on the existence of two democratic, sovereign and viable states whose people live within secure and internationally recognised borders in accordance with the relevant UN Security Council resolutions; calls on both parties not to add further obstacles or pretexts for either side not to start talks again; calls on both parties to avoid any step that may undermine the perspective of a two-state solution; calls on the Palestinian Authority as well as all Palestinian leaders to do their utmost to put an end to the multiple attacks using Qassam missiles fired indiscriminately from the Gaza strip into Israeli territory; calls on the Israeli Government to stop the extension of the settlements in the West Bank and East Jerusalem;

Wanneer op een onder deze richtlijn of de bijzondere richtlijnen vallend gebied een geschil in verband met de bestaande verplichtingen ontstaat tussen ondernemingen die diensten aanbieden waarbij een van de partijen een onderneming is die elektronischecommunicatienetwerken of -diensten aanbiedt in een lidstaat, neemt de betrokken nationale regelgevende instantie op verzoek van een van beide partijen en zonder afbreuk te doen aan de bepalingen in lid 2, een bindend besluit om het geschil te beslechten, en wel zo spoedig mogelijk of in ieder geval binnen vier maanden, met uitzondering van uitzonderlijke omstandigheden.
In the event of a dispute arising in connection with existing obligations under this Directive or the Specific Directives between undertakings providing electronic communications networks or services in a Member State, or between such undertakings and other undertakings in the Member State benefiting from obligations of access and/or interconnection arising under this Directive or the Specific Directives, the national regulatory authority concerned shall, at the request of either party, and without prejudice to the provisions of paragraph 2, issue a binding decision to resolve the dispute in the shortest possible time frame and in any case within four months, except in exceptional circumstances.

Is convinced that, without strong pressure on the two sides, the Road Map will remain ineffective, and calls on the United States Administration to assume their responsibility vis-à-vis the present crisis and to ask the Israeli Government and the Palestinian National Authority to make a serious effort to resume genuine negotiations and to launch, together with the EU, a more comprehensive dialogue and cooperation between all countries of the entire Middle East region;
