The Belgian court asks the Court of Justice whether the Flemish Decree on Use of Languages infringes freedom of movement for workers within the EU, in that it imposes an obligation on all undertakings established in the Dutch-language region, when hiring a worker for a cross‑border post, to draft all documents relating to the employment relationship in Dutch, failing which the contract is to be declared null and void by the national courts of their own motion.

Overwegende dat België , Luxemburg en Nederland luidens artikel 1 , lid 1 , tweede alinea , van het Protocol de regeling toepassen vermeld in artikel 6 , lid 3 , van de Overeenkomst van 25 juli 1921 tot oprichting van een economische unie tussen België en het Groothertogdom Luxemburg ; dat de toepassing van deze regeling ten gunste van de Luxemburgse wijn in de komende jaren van aanzienlijk belang zal blijven voor het landbouwinkomen van het Groothertogdom Luxemburg in de betrokken sector ; dat toepassing van deze regeling voorts niet van dien aard is dat zij een overwegende belemmering zal vormen voor het vrije verkeer van de betrokken produkten binnen de Gemeenschap ; dat het derhalve dienstig is voor een beperkte periode te voorzien in een verlenging van de toepasselijkheid van deze regeling ;
