I. overwegende dat de Europese Commissie tegen racisme en intolerantie (ECRI) in haar verslag van 2011 over Spanje uiting geeft aan haar zorgen over het besluit van het constitutionele hof van 2007, waarin het strafbaarstelling van het ontkennen van de Holocaust als ongrondwettelijk verklaarde; overwegende dat het vonnis luidde dat het eenvoudig, neutraal ontkennen van bepaalde feiten zonder de intentie aan te zetten tot geweld, haat of discriminatie of deze goed te praten, geen strafbaar feit is; overwegende dat vier van de twaalf rechters tegen het vonnis hadden gestemd; overwegende dat de ECRI in kennis is gesteld van het feit dat de plaatselijke leider van de Partido Popular in Badalona, een stad bij Barcelona, al enkele jaren haatpropaganda bevordert en Roemeense en Roma-immigranten ervan beschuldigt de oorzaak van het geweld in de stad te zijn; overwegende dat maatschappelijke organisaties hun zorgen hebben geuit over de "onzichtbaarheid" van racisme en rassendiscriminatie in Spanje, alsook over de passieve houding en de gebrekkige wil op lagere overheidsniveaus om het probleem te erkennen en aan te pakken; overwegende dat het gebrek aan gegevens over racisme of rassendiscriminatie de indruk wekt dat racisme niet bestaat; overwegende dat de dienst haatdelicten en discriminatie van het openbaar ministerie van Barcelona is opgericht in oktober 2009, na twee geruchtmakende rechtszaken van eigenaren van boekhandels in Barcelona die publicaties verkochten waarin genocide werd gerechtvaardigd en gepromoot; overwegende dat er op dit moment volgens de autoriteiten geen plannen zijn om deze dienst ook in andere Spaanse steden op te richten en het te vroeg is om de doeltreffendheid ervan te kunnen beoordelen;
I. whereas the European Commission against Racism and Intolerance (ECRI), in its 2011 report on Spain, expresses its concern about the Constitutional Court’s 2007 decision declaring the criminalisation of Holocaust denial to be unconstitutional; whereas the judgment states that the simple, neutral denial of some facts without any intention to justify or incite violence, hatred or discrimination has no criminal relevance; whereas 4 of the 12 judges voted against the ruling; whereas ECRI has been informed that the local leader of the Popular Party has been promoting hate speech in Badalona, a city near Barcelona, for several years, accusing Romanian and Roma immigrants of being the cause of crime in the city; whereas civil society organisations have expressed concern about the ‘invisibility’ of racism and racial discrimination in Spain, as well as passivity and a lack of will to acknowledge and deal with the problem at lower levels of government; whereas the fact that there is no data available on racism or racial discrimination contributes to the impression that racism does not exist; whereas the hate crimes and discrimination service of the Barcelona prosecution office was set up in October 2009 following two highly publicised trials of owners of Barcelona bookstores who were selling publications justifying and promoting genocide; whereas, according to the authorities, there are no plans at present to reproduce this service in other Spanish cities and it is too early to evaluate its effectiveness;
