The period of validity of those guidelines, originally to expire on 9 October 2009, was extended first until 9 October 2012 (Commission Communication concerning the prolongation of the Community Guidelines on State aid for rescuing and restructuring firms in difficulty (OJ C 156, 9.7.2009, p. 3)), and then a second time (Commission Communication concerning the prolongation of the Community Guidelines on State aid for rescuing and restructuring firms in difficulty of 1 October 2004 (OJ C 296, 2.10.2012, p. 3)), until they were replaced by new rules applied since 1 August 2014 (Communication from the Commission — Guidelines on State aid for rescuing and restructuring non-financial undertakings in difficulty (OJ C 249, 31.7.2014, p. 1)).

Ten slotte is in punt 25, onder e) van de richtsnoeren reddings- en herstructureringssteun van 2004 bepaald dat het eenmalig karakter van steun dient te worden gerespecteerd. Dit principe houdt in dat in een periode van 10 jaar nadat reddingssteun is verleend of een herstructureringsperiode werd afgesloten, de Commissie geen verdere reddings- of herstructureringssteun zal toestaan.
Finally, point 25(e) of the 2004 RR Guidelines requires that the ‘one time, last time’ principle is respected. According to this principle, where less than 10 years have elapsed since rescue aid was granted or a restructuring period came to an end, the Commission will not allow further rescue or restructuring aid.

Het gaat dan ook bij alle potentiële begunstigden van de maatregel om ondernemingen in moeilijkheden in de zin van punt 10, onder c) van de communautaire richtsnoeren inzake reddings- en herstructureringssteun aan ondernemingen in moeilijkheden (hierna „richtsnoeren reddings- en herstructureringssteun” genoemd).
Therefore, all potential beneficiaries of the measure are undertakings in difficulty within the meaning of point 10(c) of the Community guidelines on State aid for rescuing and restructuring firms in difficulty (hereinafter: the Rescue and Restructuring Guidelines).

Het maximumbedrag dat één onderneming aan reddings- en herstructureringssteun tezamen wordt toegekend, mag niet hoger liggen dan 10 miljoen EUR, met inbegrip van eventuele steun uit andere bronnen of op grond van andere regelingen.

Deze aanpak is inmiddels in punt 7, voetnoot 10, van de communautaire richtsnoeren voor reddings- en herstructureringssteun aan ondernemingen in moeilijkheden (PB C 228 van 9.10.1999, blz. 2) bevestigd. Volgens dit punt vormen de enige uitzondering op het beginsel dat een pas opgerichte onderneming niet in aanmerking komt voor reddings- en herstructureringssteun, gevallen die door de BvS worden behandeld in het kader van haar privatiseringsopdracht en andere soortgelijke gevallen in de nieuwe deelstaten, en wel met betrekking tot ondernemingen die na een liquidatie of een overname van activa die vóór 31 december 1999 is geschied, zijn opgericht.
This approach is now confirmed by point 7, footnote 10, of the Community Guidelines on State aid for rescuing and restructuring firms in difficulty: "The only exceptions of this rule are any cases dealt with by the Bundesanstalt für vereinigungsbedingte Sonderaufgaben in the context of its privatisation remit and other similar cases in the new Länder, involving companies emerging from a liquidation or a take-over of assets occurring up to 31 December 1999".

Staatssteun voor de redding en herstructurering van ondernemingen in moeilijkheden wordt getoetst aan de communautaire richtsnoeren voor reddings- en herstructureringssteun aan ondernemingen in moeilijkheden (10).
