Dit dient te gelden onverminderd het recht van de lidstaten om overeenkomstig Richtlijn 98/26/EG van het Europees Parlement en de Raad de toegang tot systeemkritische betalingssystemen te beperken, en onverminderd de bevoegdheden van de Europese Centrale Bank en het Europees Systeem van Centrale Banken betreffende de toegang tot betalingssystemen.
