Met name zijn er specifieke geografische obstakels, gezien de beperkte afmetingen van het continentaal plat ter plaatse en het feit dat de doelsoort zich uitsluitend ophoudt in bepaalde zones in de kustgebieden op diepten van minder dan 50 m. De visgronden zijn dan ook beperkt in omvang.

In die omstandigheden heeft de Rechtbank Amsterdam (Nederland) de behandeling van de zaak geschorst en het Hof van Justitie gevraagd of het Unierecht zich ertegen verzet dat een werknemer die werkzaam is op een vaste installatie op het tot een lidstaat behorende gedeelte van het continentaal plat, in die lidstaat niet verplicht verzekerd is ingevolge de nationale wettelijke regeling, uitsluitend omdat hij niet woonachtig is in die lidstaat, maar in een andere lidstaat.
Accordingly, the Rechtbank Amsterdam (Amsterdam District Court) asked the Court of Justice whether EU law precludes an employee, working on a fixed installation on the continental shelf adjacent to a Member State, from being in a position in which he is not compulsorily insured under national legislation in that Member State solely on the ground that he is not resident there but in another Member State.

5. 5. At the request of a Member State, the Commission, in accordance with the procedure provided in Article 30(2) of Regulation (EC) No 2371/2002, shall allow a derogation from paragraphs 1, 2 and 3, on condition that such derogation is justified by particular geographical constraints, such as the limited size of coastal platforms along the entire coastline of a Member State or the limited extent of trawlable fishing grounds, where the fisheries have no significant impact on the marine environment and affect a limited number of vessels, and provided that those fisheries cannot be undertaken with another gear and are subject to a management plan as referred to in Articles 18 or 19.
