Artikel 37 van Verordening (EG) nr. 1698/2005 voorziet in betalingen voor natuurlijke handicaps aan landbouwers in berggebieden ten bedrage van maximaal 250 EUR per hectare cultuurgrond en in betalingen in andere gebieden met handicaps ten bedrage van 150 EUR per hectare cultuurgrond.

In ieder geval wordt de aanvullende premie slechts verleend aan landbouwers met een bedrijf waarvan de oppervlakte cultuurgrond voor ten minste 50 % ligt in probleemgebieden als bedoeld in Verordening (EG) nr. 1257/1999.
In any event the supplementary premium shall only be granted to a farmer whose holding has at least 50 % of its area used for agriculture situated in less-favoured areas defined pursuant to Regulation (EC) No 1257/1999.

De lidstaten mogen hogere percentages vaststellen rekening houdend met specifieke situaties, waarbij moet worden gewaarborgd dat cultuurgrond in toereikende mate wordt gebruikt.
