4. Aan artikel 39 wordt het volgende lid toegevoegd: "1 bis. Wanneer het bepaalde in titel II, hoofdstuk VII, van toepassing is en de bevoegde autoriteiten van het land van vertrek het bericht van aankomst (Arrival Advice) niet hebben ontvangen binnen de termijn waarin de goederen bij het kantoor van bestemming moesten worden aangeboden, delen deze autoriteiten dit mede aan de aangever met het verzoek het bewijs te leveren dat de regeling is beëindigd".
4. In Article 39, a new paragraph 1 is inserted as follows: "1a. Where the provisions of Chapter VII of Title II apply and the competent authorities of the country of departure have not received the "arrival advance" message by the time limit within which the goods must be presented at the office of destination those authorities shall inform the principal and ask him to furnish proof that the procedure has ended".

(7) Omschreven moet worden op welke wijze de bevoegde autoriteiten de regeling zuiveren, rekening houdend met de plaats, het tijdstip en de voorwaarden waarop deze regeling wordt beëindigd, ten einde de verplichtingen van de gebruiker van de regeling duidelijker af te bakenen en zeker te stellen dat deze gebruiker volledig verantwoordelijk is wanneer de beëindiging van de regeling niet kan worden vastgesteld. Tenslotte moeten de douanevervoerprocedures veiliger en doelmatiger worden gemaakt en de zuivering door middel van operationele maatregelen en wettelijke bepalingen moet worden verbeterd zodat de bevoegde autoriteiten de regeling zo snel mogelijk kunnen zuiveren.
(7) Rules should be laid down on how the competent authorities are to discharge the transit procedure as regards the place, the time and the conditions of the ending of the procedure in order to establish more clearly the extent of and limits to the obligations of the holder of a procedure and ensure that, in the absence of evidence that a procedure has ended, the holder remains fully liable; to make the transit arrangements more secure and more efficient, operational measures and legal provisions should be introduced to improve the discharge procedure and thereby ensure that the competent authorities discharge the transit procedure as quickly as possible.
