(8) The Commission should adopt guidelines for methods for calculating the financial guarantee or equivalent insurance as set out in Article 6 of Regulation (EC) No 1013/2006, the application of Article 12(1)(g) of the Regulation, guidelines on the application of Article 15 of the Regulation, guidelines for the cooperation of competent authorities with regard to illegal shipments, further guidance concerning the use of languages and further clarification of the procedural requirements of Title II of the Regulation as regards their application to exports, imports and transit of waste from, to and through the Union, guidelines on what constitutes effective, proportionate and dissuasive penalties as referred to in Article 50(1) of Regulation (EC) No 1013/2006 and guidelines on how to conduct a risk assessment pursuant to Article 50(2a) point (b) of Regulation (EC) No 1013/2006.

B. overwegende dat voor de toepassing van artikel 26, lid 2, uitvoeringshandelingen moeten worden vastgesteld overeenkomstig lid 8 van dat artikel, vandaar de invoering van de ontwerpverordening van de Commissie in kwestie; overwegende dat overeenkomstig overweging 59 van Verordening (EU) nr. 1169/2011 in deze uitvoeringshandelingen de wijze moet worden vastgesteld waarop het land van oorsprong of de plaats van herkomst van in artikel 26, lid 2, onder b), bedoeld vlees wordt vermeld;
B. whereas the application of Article 26(2) is subject to the adoption of implementing acts pursuant to paragraph (8) of that article, hence the introduction of the draft Commission regulation in question; whereas, in accordance with recital 59 of Regulation (EU) No 1169/2011, those implementing acts must lay down the manner of indicating the country of origin or place of provenance for meat referred to in Article 26(2)(b);

In artikel 6 van verordening nr. 1 wordt echter bepaald dat "de instellingen (...) de wijze van toepassing van de onderhavige regeling in hun reglement van orde (kunnen) vaststellen".

3. Mits het met de richtlijn beoogde resultaat wordt bereikt, kunnen de lidstaten de bepalingen van artikel 4, lid 1, artikel 5, lid 1, artikel 7, lid 1, artikel 8, leden 1 en 3, en artikel 9, lid 2, omzetten, en de wijze van toepassing van artikel 5, lid 4, preciseren door middel van convenanten tussen de bevoegde autoriteiten en de betrokken bedrijfssectoren.
3. Provided that the objectives set out in this Directive are achieved, Member States may transpose the provisions set out in Articles 4(1), 5(1), 7(1), 8(1), 8(3) and 9(2) and specify the detailed rules of implementation of Article 5(4) by means of agreements between the competent authorities and the economic sectors concerned.
