[77] 7 Grounds for refusal: (a) where enforcement would run counter to the fundamental principles of the legal system of the requested State; (b) where the requested State considers the offence for which the sentence was passed to be of a political nature or a purely military one; (c) where the requested State considers that there are substantial grounds for believing that the sentence was brought about or aggravated by considerations of race, religion, nationality or political opinion; (d) where enforcement would be contrary to the international undertakings of the requested State; (e) where the act is already the subject of proceedings in the requested State or where the requested State decides to institute proceedings in respect of the act; (f) where the competent authorities in the requested State have decided not to take proceedings or to drop proceedings already begun, in respect of the same act; (g) where the act was committed outside the territory of the requesting State; (h) where the requested State is unable to enforce the sentence; (i) where the request is grounded on Article 5.e ("if it considers that it cannot itself enforce the sanction, even by having recourse to extradition, and that the other State can") and none of the other conditions mentioned in that article is fulfilled; (j) where the requested State considers that the requesting State is itself able to enforce the sentence; (k) where the age of the sentenced person at the time of the offence was such that he could not have been prosecuted in the requested State; (l) where under the law of the requested State the sentence imposed can no longer be enforced because of the lapse of time; (m) where and to the extent that the sentence imposes a disqualification.

Conclusies van de Raad : "DE RAAD VAN DE EUROPESE UNIE CONSTATEERT DAT : - het ondanks de complexe aard van deze aangelegenheid en de moeilijkheid om nieuwe bepalingen ten opzichte van de Europese Overeenkomst van 1957 op te stellen, mogelijk is geweest vooruitgang te boeken ; -het mogelijk is geweest een akkoord te bereiken over bepalingen met betrekking tot feiten die kunnen leiden tot uitlevering, alsmede over fiscale delicten, verjaring en amnestie ; -de meeste delegaties akkoord gaan met de beginselen die van toepassing moeten zijn bij uitlevering van onderdanen en het afzien van het specialiteitsbeginsel in sommige gevallen ; -andere fundamentele aangelegenheden momenteel ter discussie staan, zoals de verderlevering, de mogelijke uitsluiting van de politieke aard van het delict als reden voor weigering van uitlevering tussen de Lid-Staten, alsmede de verlichting van het beginsel van dubbele strafbaarheid ten aanzien van samenspanningen en criminele verenigingen. IS VAN OORDEEL DAT : -het belangrijk is de besprekingen voort te zetten om zo spoedig mogelijk te komen tot een Overeenkomst met betrekking tot de verbetering van de uitlevering tussen de Lid-Staten van de Europese Unie ; -daartoe bij de besprekingen rekening moet worden gehouden met de volgende richtsnoeren : =het debat over de bepalingen waarover alle Lid-Staten het eens zijn mag niet opnieuw worden geopend, =de behandeling van de andere bepalingen waarover de meerderheid der delegaties het eens is, moet worden voortgezet, met meer flexibiliteit voor de nog onopgeloste technische punten, meer bepaald de mogelijkheid van voorbehouden met een beperkte geldigheidsduur, wanneer deze toegestaan zijn, =voor wat betreft de mogelijkheid af te wijken van het beginsel van dubbele strafbaarheid moet rekening worden gehouden met het belang van deze kwestie in de strijd tegen de georganiseerde criminaliteit, =er moet in het kader van het wederzijds vertrouwen van de Lid-Staten in elkaars rechtsorde en rechtss ...
Council conclusions: "THE COUNCIL OF THE EUROPEAN UNION, NOTES that : - in spite of the complexity of the matter and the difficulty of formulating new provisions in relation to the European Convention of 1957, progress has been made; - agreement has been reached on the provisions dealing with extraditable offences, fiscal offences, lapse of time and amnesty; - it is apparent that most delegations agree on the principles which are to govern extradition of nationals and waiver of the rule of speciality in certain cases; - other fundamental questions are now under discussion, such as re- extradition, the possibility of excluding the political nature of the offence as grounds for refusing extradition between Member States and relaxation of the principle of dual criminality for conspiracy and associations to commit offences; CONSIDERS: - that it is important that discussions on a Convention on the improvement of extradition between the Member States of the European Union continue with a view to the earliest possible conclusion; - that, to this end, the discussions should bear the following guidelines in mind: = discussion of provisions on which all delegations agree should not be reopened; = examination of other provisions to which the majority of delegations have agreed, should continue, giving more flexible consideration to the technical aspects outstanding, in particular the possibility of reservations, valid for a limited period, where permissible; = account should be taken of the significance for combating organized crime of the possibility of derogating from the dual criminality rule; = a solution should be sought to the question of refusal to extradite on the grounds of the political nature of the offence, in consideration of Member States' confidence in each other's legal orders and judicial systems; = procedural aspects of extradition under the draft Convention should also be examined.
