As far as the allegations of the non-selectivity of the BesAR are concerned, it must be recalled that ‘neither the large number of eligible undertakings nor the diversity and size of the sectors to which those undertakings belong provide any grounds for concluding that a State initiative constitutes a general measure of economic policy’ (31), as long as other sectors, such as for instance services, are excluded from the scope of beneficiaries.

Zo heeft het Hof in zijn antwoord op de tweede vraag meer in het bijzonder vastgesteld dat noch het grote aantal begunstigde ondernemingen, noch de verscheidenheid en het belang van de sectoren waartoe deze ondernemingen behoren, aanleiding kunnen zijn om een overheidsinitiatief als algemene maatregel van economische politiek te beschouwen (43).
