Het Hof oordeelde dat bij gebreke van harmonisatie van de nationale regelingen voor inning van niet-betwiste schuldvorderingen, de wijze waarop de nationale betalingsbevelprocedures ten uitvoer worden gelegd, een zaak van de interne rechtsorde van de lidstaten is krachtens het beginsel van procedurele autonomie van die staten, op voorwaarde evenwel dat deze nadere regels niet ongunstiger zijn dan die welke voor soortgelijke situaties krachtens intern recht gelden (gelijkwaardigheidsbeginsel) en de uitoefening van de door het Unierecht aan de consument verleende rechten in de praktijk niet onmogelijk of uiterst moeilijk maken (doeltreffendheidsbeginsel)
The Court held that in the absence of harmonisation of the national mechanisms for recovery of uncontested claims, the rules implementing national order for payment procedures are a matter for the national legal order, in accordance with the principle of the procedural autonomy of the Member States, on condition, however, that they are no less favourable than those governing similar domestic actions (principle of equivalence) and do not make it in practice impossible or excessively difficult to exercise the rights conferred on consumers by European Union law (principle of effectiveness).
